Traffic Safety Resource Prosecutor (tsrp) The candidate will provide critical support to enhance the capability of Pennsylvania’s prosecutors to effectively prosecute traffic safety violations. Generally: provide on-site training and assistance on traffic safety issues to individual District Attorney’s offices as requested provide technical assistance to District Attorney’s offices from PDAA/PDAI Headquarters via phone, fax, and e-mail prepare and present traffic safety appellate updates at PDAI courses several times a year; prepare and present case law updates and other trainings for law enforcement; submit timely e-mails to membership highlighting important court decisions; Maintain the Impaired Driving Manual and Case Law Digest. Prepare or update course and reference materials respond to articles published in law journals/magazines and emerging traffic safety issues as needed. Specifically, as set forth by NHTSA and PennDOT: Assess training needs, develop and provide training programs for prosecutors, law enforcement officers and other traffic safety professionals with an emphasis on the effective prosecution of impaired driving cases. Provide technical assistance and legal research to prosecutors on a wide variety of legal issues, including probable cause; Standardized Field Sobriety Testing (SFST); Drug Evaluation and Classification (DEC) Program; implied consent; breath/blood testing; accusatory instruments; pre-trial procedures; trial practice; and appellate practice. Serve as a resource to prosecutors and police officers in the State on impaired driving and other traffic cases. Compile a database of briefs, legal memoranda, pleadings and foundational questions for use at hearings, trials or on appeal of such cases. Train and provide technical assistance to State, local and county law enforcement is needed methods of evidence gathering, especially newly emerging technology and trial techniques, that will improve the ability of prosecutors to effectively prosecute impaired driving cases. Prepare a quarterly newsletter for prosecutors regarding “hot topic” issues of highway safety. Plan and Administer one 2.5-day class (Protecting Lives Saving Futures Class, Prosecuting the Drugged Driver, and Lethal Weapon, HBV) on a rotating basis, is needed accordance with the NDAA/NHTSA course curriculum. Plan and Administer one 2.5-day Traffic Safety Prosecutors Conference per calendar year. Coordinate with the PennDOT to serve as the liaison with additional prosecutors to enable them to become more involved in traffic safety initiatives. Publicize the technical assistance that TSRPs can provide to prosecutors, law enforcement, toxicologists, breath testing operators, and other advocates. Respond to written and oral inquiries made by prosecutors concerning criminal law, associated administrative issues, procedure or special problems, and offer competency and expertise in providing a broad range of technical assistance and support services for prosecuting traffic safety offenses. Meet regularly with law enforcement agencies to explain prosecutorial policy, answer questions, and receive suggestions; foster improved law enforcement /prosecutor cooperation; strengthen effective law enforcement and prosecution strategies; and regularly apprise prosecuting attorneys on evolving areas of traffic safety law. Serve as a liaison, develop and maintain a rapport with officials at the Department of Health. Provide commentary, when appropriate, regarding certification of facilities for blood testing, certification of breath testing instruments, and techniques used to obtain, store and analyze samples. To the extent practicable, serve as a participant in the State’s Impaired Driving Task Forces. Promote heightened awareness by law enforcement officers and prosecutors of victims’ issues. Upon request of a District Attorney, serve as second chair on difficult impaired driving cases, including but not limited to Frye, Daubert, other suppression hearing, motions, etc. Make presentations and participate in National, State and local meetings on traffic safety issues. Develop and maintain a working relationship with the National Highway Traffic Safety Administration (NHTSA), National Association of Prosecutor Coordinators (NAPC), National Traffic Law Center (NTLC), Prosecutor Fellow and other TSRPs.

Qualification and Experience

The candidate should have Juris Doctorate or equivalent degree from a law school accredited by the American Bar
Association or the Supreme Court of the State. Must be member in good standing of the Pennsylvania Bar. Should have extensive experience in the prosecution of impaired driving cases. Must have knowledge of the NHTSA/International Association of Chiefs of Police (IACP). Standardized Field Sobriety Testing (SFST) and the Drug Evaluation and Classification (DEC) Program is required. Must have knowledge or willingness to learn about sobriety checkpoints and saturation patrol operations. Preference will be given to applicants who, in addition to the minimum qualifications, possess one or more of the following: Demonstrated a clear, concise writing style.
Attended an instructor development training program. Familiarity with PowerPoint and Adobe Acrobat. Facilitate or conduct training for prosecutors and law enforcement officers on traffic safety issues. Develop and maintain a log of all technical assistance provided to prosecutors, law enforcement, toxicologists, breath testing operators, and other advocates. Develop and/or participate in public service announcements, earned media and press events specifically during special enforcement periods. Participate in law enforcement activities, for example, roll call, sobriety checkpoints, saturation patrols, and training. Participate in establishing and revising sobriety checkpoint, saturation patrol or other enforcement guidelines. Develop and revise a DUI manual for prosecutors to assist in the prosecution of impaired driving cases. The manual could include information on current case law, pre-trial, traffic stops, probable cause, breath and blood testing procedures, proof of impairment, chain of custody, sentencing procedures, vehicle forfeiture, common defenses, and examples of forms used in the State. Complete expense reports as needed and bi-weekly Time Sheets. Report Activities to PennDOT assist with preparation of invoices and related paperwork, TSRP budget and continuation application for grant funding Plan, coordinate, and manage all TSRP trainings. This includes venue selection, contract review, speaker acquisition, advertising, and registration management.
