Health & Benefits Compliance Associate
The candidate will be responsible for the gathering of information required to be in an ERISA document. Cross checking of information provided by Insurers/TPAs versus employer plan operation and administration. Verification of plan terms. Trouble shooting for compliance in the areas of HIPAA privacy, ACA and wellness programs as they relate to plan documents. Follow up with team colleagues/clients as to missing and/or incorrect information. Ability to recognize and research or seek assistance with compliance concerns ascertained from gathered information. Ability to recognize less common plan document issues such as employer participation/sponsor in a MEWA, Trust or Association participation, or Multiple Employer Trust situations. Interactive conversations with both clients and team colleagues as to the requirement for plan document compliance, pitfalls employers encounter when documents are poorly drafted or nonexistent, and process for obtaining a plan document. Maintain documentation of information received regarding plan document including certificates of coverage, correspondence and communication to/from the law firm partner. Collateral responsibilities include reporting of plan document information to Plan Document/Form 5500 Filing Center oversight managers, i.e., clients serviced, documents provided, and revenue received. Administrative responsibilities in assisting with webinars and compliance mailbox administration when needed. Check and edit plan document worksheet forms and supporting documentation for accuracy and conflicting information. Organize and track plan document files. Everyday interaction with team colleagues; interaction with law firms and clients.

Qualification and Experience

The candidate should have thorough knowledge and experience with ERISA disclosure and reporting requirements; In depth knowledge and experience with correlating federal laws governing employee benefit plans, including HIPAA (privacy and wellness), COBRA, ACA, and FMLA; Highly organized, recognizes importance of deadlines; Handles pressure well and gives attention to detail and accuracy; Analytical skills relating to practical application of legal aspects of employee benefit plans; Strong verbal and written communication skills; and relevant computer software knowledge and experienced, i.e., Word document and Excel spreadsheet capabilities. Associates Degree in Paralegal Studies (Bachelor’s degree is preferred). Primary legal work experience of 10 years in the field of employee benefits, i.e. ERISA, HIPAA, ACA, COBRA (not inclusive). Commensurate experience with a Paralegal Certificate will be considered.
