Senior Legal Counsel The candidate will advise the Company and provide legal support on a range of claims and litigated matters, act as primary liaison with Human Resources regarding employment and human resources-related issues, including Title VII, Family Medical Leave Act, Age Discrimination in Employment Act, the Americans with Disabilities Act, and other federal and state employment laws, as well as handling matters such as employment agreements, independent contractor/employee classifications and other matters and projects as assigned by the Deputy General Counsel. In addition, the Senior Counsel will oversee the Company's Compliance Program. The position is responsible for establishing standards and procedures to reduce illegal, unethical and improper conduct, for ensuring these standards are communicated and institutionalized throughout the Company, including training, and for monitoring the Company's compliance with these standards and procedures.
Qualification and Experience
The candidate must be admitted to GA Bar or eligible to obtain admission as In-House Counsel. Should have Significant experience with pre-suit claim evaluation with a demonstrated record of litigation avoidance. Must have substantive knowledge of Motion and Discovery Practice to include E-discovery and litigation hold processes. Experience with accurate Budgeting of Expense and Exposure, managing and reporting on Budget Status and Reserves is required. Should have experience with defense of EEO claims at the federal and state level, including investigation, preparation of statements of position, on-site investigations and conciliation efforts. Must have expertise in all areas of employment law with particular emphasis on Title VII, ADA, ADEA, FMLA and wage and hour laws. Oversight and management of outside counsel, including litigation is required. Must have experience interacting with and advising corporate officers and senior management on legal matters relating to employees. Should have experience developing, reviewing, maintaining and updating company compliance policies and procedures to identify potential areas of compliance vulnerability and risk of illegal, unethical or improper conduct, as well as supervising day-to-day implementation across multiple departments. Must have experience identifying changes in applicable rules, regulations, standards and related trends that are relevant to a compliance program and make necessary modifications to policies and procedures. Should have experience interacting with corporate officers and senior management on matters relating to operation, performance and progress of compliance efforts, including undertaking periodic compliance audits. Must have experience designing and executing education and training programs for employees whose functions or responsibilities involve compliance with laws or standards of conduct, including introductory training for new employees and ongoing training for all employees and directors. 7-10 years’ experience in the practice of law with both law firm and in-house experience preferred. Hands on mediation, arbitration and trial experience preferred. Hands on training experience preferred. Should have strong verbal and written skills, including excellent contract drafting skills. Strong leadership skills - confident in leading others and making difficult decisions. Should have demonstrated critical thinking skills for problem solving and comfortable working with multiple priorities in a deadline driven industry
