Director, Commercial Contracts Duties: Align with Commercial Operations Management and Pricing Strategy teams in the development of contracting strategy for all market segments. Make recommendations on all contract management policies, procedures and financial issues to the Leadership Team. Develop and execute new contract strategies and frameworks to drive continuous improvements across all customers and business segments. Drive operational excellence by implementing process improvements for the Commercial Operations Contracts team, specifically in the area of contract development, contract execution, contract operations, gross to net management, and rebate management. Direct a team that is fully accountable for the design, development, and maintenance of the contracting, and contract operations processes to support contracted sales of >$2B annually Manages lifecycle of executed contracts, including new contracts, renewals, amendments, terminations, etc. Draft documents in support of new product launches. Develop contract documents, including standard templates, complex agreements and amendments in support of the Commercial Operations business. Participate in contract strategy development with new and existing customers to drive performance with Commercial Operations team. Conduct contract negotiations, escalate issues to legal counsel and provide strategic recommendations to internal stakeholders. Frequent contacts with internal personnel and outside customer representatives at various management levels concerning operations or scheduling of specific phases of projects or contracts. Conducts briefings and participates in technical meetings for internal and external representatives concerning specific operations. Lead and/or support customer contract negotiations regarding key business terms and legal terms, including developing negotiation strategy, coordinating financial analysis of negotiation decisions, and driving customer discussions to come to agreement. Inform Commercial Operations senior management on contract issues with customers and assists in developing action plans for resolution. Responsible for oversight of contracting systems, ensuring all executed agreements are properly loaded into system. Maintain strong collaborative relationship with Legal and Commercial Operations to ensure contract language meets the needs of the business. Ensure all financial, legal, and corporate guidelines are met. Ensure compliance of contracts with all legal, company, systems, and audit requirements. Manage contracting system (Siebel) ensuring all contract maintenance is documented properly for compliance and process controls purposes. Responsible for maintaining Sarbanes-Oxley compliance (SOX) for contracts group. Work on ad-hoc contract projects supporting new business development as well as ongoing Commercial Operations initiatives. Act as delegate for Vice President, Pricing & Contracts as needed for meetings and projects.
Qualification and Experience
Requirements: B.S./B.A required. JD Degree /MBA preferred. 7-10 years pharmaceutical experience preferably in Generics with emphasis in contracts and commercial operations. Superior oral and written communications skills. Superior Technical writing ability (contracts). Ability to think strategically. Analytical aptitude. Strong organizational skills. Knowledge about generic market preferred. Highly developed time management skills with demonstrated ability to meet deadlines and handle multiple priorities with a high degree of initiative required. Experience in managing a high performing team and developing talent. Ability to work across functions.
