Assistant United States Attorney (AUSA) - Civil Duties: Focus on the office’s Affirmative Civil Enforcement (ACE) cases, where will be responsible for the investigation and litigation of ACE matters, including health care fraud cases, civil violations of the Controlled Substances Act, and other affirmative investigations. May also include defensive tort actions, suits brought under the Administrative Procedures Act, bankruptcy actions, state and federal foreclosures, social security cases, Touhy issues, Bivens cases, summons enforcement actions, ADA enforcement proceedings, and other miscellaneous civil matters. Depending on office needs and candidate preferences, may also have some responsibilities for handling criminal cases and criminal appellate matters (including arguments before the United States Court of Appeals for the Eighth Circuit), as well as some limited responsibilities for responding to petitions under Title 28 United States Code Section 2255. May include handling all aspects of investigations – including gathering evidence, taking testimony, writing briefs, participating in negotiations, and appearing in court or at trials – as well as researching legal issues, drafting legal pleadings and memoranda, drafting and responding to discovery requests, reviewing and organizing documents, taking and defending depositions, and representing the United States as primary and/or secondary counsel in judicial proceedings, such as hearings, trials, and appeals in various federal, bankruptcy, and state court actions.
Qualification and Experience
Qualifications: Must have a JD Degree, be an active member of the Bar (any U.S. jurisdiction), and have 1+ year post-J.D. professional legal or other relevant experience as of the closing date of this announcement. Preferred Qualifications: Preferred applicants will possess civil litigation or significant legal writing experience. Should be committed to public service, possess superior oral, written, and interpersonal communication skills and should demonstrate incisive analytical ability, excellent judgment, and strong advocacy skills.
