Senior Counsel, Environmental The candidate will manage review of applicable existing and proposed environmental laws and regulations to prepare regulatory comments, represent the company in litigation and administrative proceedings and advocate for the company before regulatory agencies. Will manage outside environmental counsel, including coordinating the selection and hiring of outside counsel to support business needs. Consult with relevant stakeholders to respond to NOVs or other enforcement actions and pursue cost-effective resolution strategies with regulators or litigate. Provide environmental counseling in connection with M&A and other commercial activities, including drafting and reviewing environmental contractual provisions. Provide legal counsel to Environmental Services, Plant Operations, Regulatory Affairs and other support groups regarding legal requirements of applicable environmental rules and regulations. Facilitate monthly Environmental Strategy Meetings to discuss and develop the companyâ€™s environmental strategy regarding rule-makings, litigation, enforcement actions and advocacy. Advise relevant stakeholders regarding environmental laws, rules, and regulations to assist the company in determining its compliance obligations.
Qualification and Experience
The candidate should have JD degree, law license in Texas (or other state license and willingness to become licensed in Texas). Should preferably have 7+ years of environmental legal experience, with in-house experience for an energy company. Working knowledge of regulations impacting power generation, including CAA, CWA, RCRA, EPRCA and others is essential. Familiarity and relationships with EPA and state environmental agencies preferred. Strong interpersonal and communication skills, both written and verbal and ability to manage a full environmental legal docket is essential. Leadership in setting direction of environmental strategy for Vistra Energy is needed. Strong skills in resolving legal issues is needed.
