Associate General Counsel; ES 00 Duties: The candidate advises the General Counsel, who is the agency's Designated Agency Ethics Official, on matters concerning the agency's ethics program; Resolves tort claims against the agency or refers them to the Department of Justice as appropriate. He or she is also responsible for proposing and promulgating revisions to the regulations implementing the Act at OPM; Supports the adjudication of other claims against the agency and he or she is responsible for proposing and promulgating revisions to the relevant regulations; Oversees the process by which the General Counsel determines whether to grant requests for testimony or documents in litigation not involving OPM; Oversees representation of the agency in administrative litigation including Governmentwide matters, such as administration of pay and leave, retirement, health and other insurance programs or products, and the Combined Federal Campaign; Oversees representation of the agency in administrative litigation pertaining to OPM's internal administration including procurements, contract administration, and tort claims; Oversees the coordination of litigation support to the Department of Justice when agency determinations concerning, for example, pay and leave, retirement, health and other insurance programs or products, the Combined Federal Campaign, and others; Oversees the provision of advice and assistance concerning the rules and guidance established by OPM for other agencies on a host of complex matters including pay and leave, retirement, health and other insurance programs or products; Supervises advice on matters involving only OPM and its employees, including for example, procurements, contract administration, and ethics; Makes recommendations to the Deputy General Counsel concerning retirement matters before the Merit Systems Protection Board in which it may be appropriate to intervene or seek reconsideration.
Qualification and Experience
Qualifications: The candidate must be a graduate from a law school accredited by the American Bar Association and be a member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico bar. Proof of bar certification will be required prior to appointment.
