AVP and Counsel - Claims Advisory The candidate will be part of the team responsible for providing primary legal counsel to the life and accident insurance company benefits operations teams in all US sites and on all product lines. Will act as an advisor to Benefit Operations staff and leadership on policy related questions, issues and trends. Partner with Benefits Operations to identify and address claim-related legal issues as they arise, providing real time legal guidance on a wide variety of products and issues. Coordinate with Benefits Operations leadership and resource partners to support and reinforce key messages and observations. Monitor the external environment to identify and address legal trends. Facilitate communication and information sharing between the front and back ends of the business. Analyze and formulate positions on claims consistent with applicable case law, legislation and regulations. Incorporate and apply federal and state laws and regulations (including ERISA), insurance laws and regulations, and employee benefit laws affecting insurance, as well as new and emerging areas of the law such as e-commerce and privacy, to business plans and objectives. Provide support to designated business teams, manages workflow from and relationship with all levels of employees and management for such teams. Keep legal management team apprised of and solicit their input as appropriate on significant legal issues. Identify law-related training needs; develops and delivers training through various mechanisms including written materials, classroom and staff presentations. Ensure that all business clients give appropriate attention to the Code of Conduct and Legality Policy. Actively participate in the development of support staff (paralegals).
Qualification and Experience
The candidate should have a J.D. (law) degree with admission to practice law in at least one jurisdiction. Knowledge of the state and federal regulatory environment, including state filing and compliance requirements and processes preferred. Insurance product knowledge desired. Strong people and change management skills are an asset. Should be knowledgeable about life, health and HIPAA accepted insurance products, familiar with federal and state laws that impact products and services.
