Senior Regulatory Counsel
The candidate provides legal advice and support to the organization regarding complex regulatory laws and regulations, including US federal and state anti-kickback statutes, Stark, Sunshine Act, and regulations and policies of CMS, HHS, and other government organizations, international anti-corruption and bribery laws and regulations, and US federal and state privacy laws and regulations. Additionally, the Regulatory Senior Counsel helps to create and provide training on the foregoing laws and regulations, both within the Legal & Compliance organization as well as other parts of the organization. Reports to Chief Regulatory Counsel. Will work with everyone in Legal and Compliance (including Managing Senior Counsels and Chief Privacy Officer) as well as business leaders. Provide internal clients with advice on healthcare regulatory matters involving the anti-kickback statute, interoperability, the False Claims Act, fee-splitting, Medicare and Medicaid billing. Stay abreast of healthcare regulatory developments (proposed and final regulations, case law, agency guidance, etc.). Assist in negotiation and drafting of customer and vendor contracts with respect to healthcare regulatory issues. Review, draft, revise, and maintain Company policies and procedures relevant to healthcare regulatory issues. Conduct legal research, draft memoranda and make educational presentations on healthcare regulatory issues.

Qualification and Experience

The candidate should have Juris Doctor Degree from an ABA-accredited law school with excellent academic credentials; admission to practice in good standing as a member of a jurisdiction is required. Should have 10 years of experience providing regulatory legal counsel to healthcare payor and/or provider clients at a large law firm, Fortune 500 company, or government agency. Government agency experience preferred; Master of Laws (LLM) Preferred. General knowledge of tax issues preferred. Must have strong knowledge of healthcare laws and regulations including HIPAA, False Claims Act, Federal, and State Anti-Kickback Statutes, Medicare, Medicaid, and the Affordable Care Act. Must have experience working with healthcare regulations including Federal and State Anti-Kickback Statues, and experience working with federal and state healthcare agencies is needed. Must have Medicare/Medicaid regulatory experience is required. Healthcare plan/provider experience. Strong privacy and security background with experience advising on HIPAA’s Privacy, Security and Breach is required. Must have expertise at drafting legal memos, advice documents, policies, and training documents. Should have Comprehensive understanding of business/joint ventures structures, regulatory matters, and risk management. Must have experience working independently and confidently with minimal guidance. Must be able to collaborate and build partnerships with internal & external customers and promote the reputation and integrity of the Legal and Compliance organizations and the Company/ Should have advanced communication skills (verbal, written, listening) including the ability to communicate professionally with regulators, executives, clients, and operations staff at all levels in a fast-paced environment.
