ProfileAttorney V The candidate: Serves as legal adviser to the Consumer Protection Division, environmental regulatory programs. Represent the agency in enforcement actions and administrative hearings, including at the State Office of Administrative Hearings. Work with program staff and leadership to draft and/or review agency rules and policies. May be required to attend and testify at Council meetings. Researches, reviews or drafts laws, rules, and regulations affecting agency operations. Assists in formulating, coordinating, and establishing policies and procedures. May analyze or draft bills and amendments for legislative consideration. Assists the Office of the Attorney General with agency representation in civil actions brought by or against the agency. Other duties as assigned include but are not limited to actively participating and/or serving in a supporting role to meet the agency’s obligations for disaster response and/or recovery or Continuity of Operations (COOP) activation. Such participation may require an alternate shift pattern assignment and/or location. Attends work on a regular and predictable schedule in accordance with agency leave policy. Should have knowledge of legal principles, practices, and proceedings and of laws, regulations, and rules relating to the System. Extensive knowledge of administrative law, administrative rulemaking and the Texas Administrative Code. Knowledge of Administrative Procedures Act (APA), Open Meetings Act, and Public Information Act. Skill in legal research, writing and critical analysis. Skill in dealing tactfully with other people, computer literacy, and problem solving. Ability to work independently and with limited direction and to manage a diverse workload. Ability to interpret and apply laws. Ability to communicate effectively. Ability to prepare opinions, contracts, rules, and policies. Ability to express comments and opinions clearly and logically. Ability to work harmoniously with System programs, administration, and other customers. Should have Law License in good standing from the State Bar of Texas. Must have experience in legal principles, practices, and proceedings. Should have experience in administrative law and hearings. May substitute civil litigation experience. Experience with administrative rulemaking preferred. Experience in preparing opinions, rules, and/or policies related to administrative law and/or government law. Should have experience in conducting research.
