Corporate Counsel - Regulatory Matters and Litigation Responsibilities : The candidate will be collaborating with and advising all levels of the business, from entry level to executive level, regarding business strategy and risk assessment related to national and international laws and regulations and other industry standards regulating company products (such as vehicle regulations issued by EPA, CARB, NHTSA, etc.). Providing legal counsel to product investigation and quality assurance teams as well as engineering and technical staff related to various topics that may impact customer satisfaction, marketing approach, and/or safety considerations. Supporting operational and safety / security teams on various issues impacting employee work environment, including, for example, incident response investigations and OSHA investigations / inspections. Advising company’s information systems group related to cybersecurity threats and domestic and international privacy considerations and obligations. Developing, and / or supporting the development of, policies and procedures to improve operational efficiencies and / or compliance with applicable legal requirements / regulations; for example, litigation hold policy, record retention policy, information protection / privacy policy, etc. Supporting sales / marketing / account managers / service engineers in providing customer communications consistent with the company’s product compliance obligations, and with the company’s technical data and integration capabilities. Serving as final approver for all publications pushed to distributors, dealers, customers, etc. related to product modifications, changes, and / or updates to ensure consistent cross-functional messaging and compliance with various regulatory requirements or expectations. Participating in engineering design process (both software and hardware) to assess legal risks, for example, safety, cybersecurity, privacy, etc. Overseeing portfolio of all domestic and international claims / charges, or potential claims / charges, in all areas of law, including product liability, warranty, lemon law, commercial, intellectual property, labor and employment, asbestos, personal injury, property damages, etc. Managing litigation hold processes and coordinating the Company’s responses to discovery, subpoenas and other requests for information. Evaluating, retaining, training, managing, and directing outside counsel assisting with pending regulatory matters and litigation. This task requires a cross-functional understanding of hot topics within the business, to be in a position to provide outside counsel with the proper scope, landscape, and context to make strategic commercial and legal recommendations. Presenting evaluations and risk assessments to the company’s executive leadership team.
Qualification and Experience
Requirements : The candidate should have a Juris Doctor (JD) and an active Indiana license to practice law in good standing. Seven or more(7+) years of experience handling litigation in various areas of law, including, for example, toxic tort, product liability, commercial, labor and employment. Seven or more years of experience overseeing and managing national litigation, or managing local counsel, including developing and maintaining consistent strategy across all jurisdictions. Experience working with products regulated by federal and state regulatory agencies, preferably vehicle regulatory schemes as set forth by the EPA, CARB and/or NHTSA. Experience coordinating multiple programs across business segments. Desire to learn new areas of the law and develop expertise in any number of substantive areas of the law that could include litigation, corporate, transactional, employment and product compliance. Must be a team player and have Curiosity and adaptability.
