Assistant Vice President & Assistant General Counsel - Litigation The candidate provides legal advice and services to company including the Chief Executive Officer, Senior Leadership Team and Hospital/Division Presidents in accordance with federal and state law. The AVP and Assistant General Counsel is part of Leadership and provides counsel for all of the business units of the system. This position reports directly to the Vice President and Deputy General Counsel of company. Will be focused on formulating litigation approaches, managing and overseeing professional and general liability claims and litigation, and actively contributing to company’ overall risk management strategies. Legal advice and services may also include revieing and drafting of healthcare related contracts; HIPAA Privacy and Security advice, formation of business entities, including networks of providers, and advising on the application to fraud and abuse, civil monetary penalties, antitrust, licensure, tax exemption, reimbursements, and Stark laws to healthcare transactions and contracts with providers. Oversee and manage the delivery of legal services by outside counsel as retained by the General Counsel for company. May provide services regarding a range of legal issues including regulatory and compliance matters, risk management and patient care matters, advance directives, guardianship, consent, billing, and Medicare and Medicaid compliance.
Qualification and Experience
The candidate must be a college graduate and possess a Juris Doctorate from an accredited law school. Must be a member in good standing with the Georgia State Bar or hold licensures in another state and eligible for Georgia State Bar. Must have demonstrated 10-15 total years of significant legal experience in a health care system, large corporation, and/or major law firm, including primary and independent responsibility for litigation, including medical malpractice, general liability, and insurance coverage. 10 years healthcare law experience required. Significant professional liability trial experience and/or experience in managing professional liability claims required. Must demonstrate effective leadership and management skills as well as demonstrate excellent written and verbal communication skills, including the ability to draft legal documents and correspondence and translate legal complexities into terms readily understood by senior leadership, management, and operations staff. Must be able to respond to inquiries from regulatory agencies, customers and business community while adhering to internal compliance policies and required state and federal regulations. Must have ability to provide legal advice in plain language and in a collaborative manner. Should have working knowledge of Westlaw, Microsoft Office, and other legal support technologies.
