Attorney V - Subrogation The candidate will handle the most complex subrogation matters and trials in the subrogation department, and provide research, advice and counsel to the Legal leadership team, Claims leadership team and other business partners. Will be responsible for handling, and appearing, on complex cases in various venues and jurisdictions in California, and occasionally out of state, for matters involving workers' compensation issues, and Federal and State civil law. Competently and aggressively handle the most complex, sensitive and difficult matters in the department, including: competently handling the most complex civil and workers compensation matters affecting State Fund's subrogation rights, in a timely, proactive manner; developing strategies to address statewide and regional trends; providing timely highly competent in-depth research, advice and counsel to the Claims and Legal leadership, members of the Executive team, Board of Directors and other senior leaders on the most difficult, complex and sensitive matters; providing timely research and advice, along with serving as a resource, to Claims and Legal personnel and other business partners; providing training to Claims, Legal and business partners, both one-on-one and in a group setting; competently collaborate with state fund's complex legal unit; leading and collaborating on group projects and assignments within legal and with business partners; and serving as a backup to the Assistant Chief Counsel and to other Attorney Vs as needed. Effectively and competently represent State Fund, its insureds and the State Departments under the Master Agreement and consistent with the law and State Fund's approved policies, procedures, and guidelines. Advise and counsel legal units, Claims and internal business partners. Provide quality customer service in a timely manner. Maintain a high level of professionalism with State Fund, its insureds, its clients, and the legal community. Comply with the Code of Conduct. Maintain a safe working environment. Defend State Fund against fraudulent activities. Maintain good customer relationships with internal and external business partners and stakeholders. Properly maintain assigned equipment. Should have active membership in the California State Bar. Must have 13+ years of legal experience in the practice of law, 3 years of which must have been at a level of responsibility equivalent to an Attorney IV. Should have knowledge of: Legal research methods and performing research; legal principles and their application; scope and character of California statutory law and of the provisions of the California Constitution; principles of administrative and constitutional law; trial and hearing procedure; and rules of evidence; court procedures; administrative law and the conduct of proceedings before administrative bodies; legal terms and forms in common use; statutory and case law literature and authorities; and provisions of laws and Government Code sections administered or enforced. Note: This position is open to individuals who are currently in the classification, eligible for lateral transfer, eligible for reinstatement, eligible for a Training and Development assignment, have SROA and/or Surplus eligibility, or have list eligibility (or are in the process of obtaining list eligibility).
