Associate General Counsel & Director, Risk Management
Reporting to the Deputy General Counsel and Deputy Litigation Counsel, this position serves Northwest Community Healthcare as legal counsel in the following areas: contracting, strategic transactions, risk management and Legal Affairs Department matter management. Provides substantive legal advice and counsel to internal clients in respect to a broad array of both complex and routine organizational legal issues, with a strong focus on risk management. Provides legal support on contracting and transaction matters. Serves as the lead on legal matters management, in an effort to provide best in class, efficient and cost effective services to the organization. Supervises risk management and patient relations staff. Drafts, reviews, and negotiates health care vendor agreement and other key agreements including physician employment agreements, and consulting and confidentiality agreements. Provides support to the Deputy General Counsel on complex transactions including asset purchases, joint ventures, physician alignment arrangements, and purchases of physician practices. Performs due diligence activities and contracting support related to strategic initiatives. Serves as the Legal Affairs Department Matter Manager, overseeing legal matters management with a strong focus on data management systems, tools and processes. Oversees day to day matter management and operations related to the Legal Affairs department and provides program management, operational and communications initiatives. Ensures the proper systems, processes and tools are in place to deliver legal services in the most efficient and cost-effective manner. Leads continuous improvement efforts for processes, tools, metrics and trainings based on the organization’s Strategic Plan, the Legal Affairs Department’s mission and vision statement, ongoing experience, process metrics and feedback from Department members, internal clients and key stakeholders. Provides day to day supervision of Risk Management and Patient Relations staff. Interviews, hires, disciplines and discharges (when necessary) subordinate team members. Regularly evaluates the performance of team members in accordance with the hospital’s performance management system. Supports development of team member’s knowledge and skills through regular feedback, recognition of positive accomplishments and coaching opportunities. Oversees implementation, facilitation and management of enterprise wide occurrence reporting system. Leads organization in collection of occurrence data and information and potentially compensable events. Manages team of “first responders” to provide immediate review and response to occurrences. Performs investigation and evidence preservation, as necessary. Advises senior leadership team of critical events in a timely manner. Responds to occurrences with preventive approach and focus on future. Interface and liaison with families and medical staff with regard to occurrences as needed. Develops policies and procedures on non-punitive reporting environments and consults as requested with human resources and NCH leaders to develop responses for staff involved in incidents or errors. Provides pre-Claim management of Patient concerns. Implements, facilitates and manages the activities of the Patient Relations team including overseeing problem resolution and grievance management. Develop policies and procedures relating to early disclosure of incidents and family communication designed to optimize outcomes for all parties. Participates in interdepartmental or multidisciplinary teams to ensure that Risk Management and Patient Relations activities and principles are effectively integrated throughout the organization and to ensure the coordination of services across the continuum. Reviews patient grievances with the potential to develop into legal action. Meets with patient and family and or medical staff members, as appropriate, as soon as possible after incidents and develop appropriate rapport. Interfaces with house wide departments that receive feedback directly from patients. Oversees operations of the Risk Management Department. Develops short and long-term goals for Risk Management/Patient Relations and the plans to accomplish such goals. Assesses and recommends the resources that are needed to accomplish agreed upon goals. Develops, secures approval for, and manages the budget in accordance with approved plan. Formulates policy for the departments’ services and secures appropriate approvals. Regularly evaluates the performance of personnel according to the guidelines of the hospital’s performance management system. Ensures team members are oriented to the department and hospital. Allocates time for educational meetings; collaborates with others responsible for organizational wide education to ensure learning needs are identified and addressed. Maintains an environment which promotes individual and professional growth. Together with Legal Affairs Department leadership team, assists with policy implementation and review process, in compliance with regulatory requirements and in adherence to best practices. Adheres to all Northwest Community Healthcare standards, policies and procedures.

Qualification and Experience

Qualifications: JD law degree from an ABA accredited law school required. 5+ years of litigation or risk management experience at a law firm or in-house with an established corporate law department. First chair experience at trial and/or arbitral hearings preferred. Healthcare experience preferred. Current licensure by the Illinois Supreme Court and admitted to the State Bar of Illinois. Demonstrated understanding of health care related issues including Stark, Anti-kickback, HIPAA and current laws relating to the delivery of health care, and legal department management of databases and related tracking and processing systems preferred. Demonstrated experience in Legal Affairs Department Matter Management, including contract and policy management and review preferred. Previous Registered Nurse experience preferred. Certification in Healthcare Risk Management – CPHRM preferred. Strong interpersonal, analytical, organizational, and communication skills to effectively interact with all levels of hospital staff. Ability to work collaboratively to achieve established goals and exercise independent judgment with minimal supervision or oversight. Commitment to provide best in class legal counsel in an environment consistent with the mission and vision of Northwest Community Healthcare. Advanced knowledge and experience with Legal databases and management systems. Computer proficiency especially with Microsoft Office Suite applications.
