Assistant General Counsel - Tolling The candidate will provide legal advice, direction and representation in connection with wide-ranging toll collection and violation enforcement litigation and other toll related matters, projects and initiatives. Undertake civil litigation, from inception (drafting and preparing complaints for filing and service) through trial/settlement and appeal, and other efforts to collect unpaid tolls and violation fees from scofflaw toll violators. Represent the Authority by handing toll collection and violation enforcement litigation and appear at all assigned conferences, hearings, motions, trials, and appeals. Provide legal advice, direction and representation regarding toll collection and violation enforcement under open road Cashless Tolling (ORT) including, legislative initiatives, registration suspension, criminal prosecutions, exclusion orders, etc. Provide legal advice, direction and representation regarding toll policy including but not limited to toll increases and rebates/discounts, ORT, one-way tolling, compliance with State Administrative Procedure Act (SAPA) and the State Environmental Quality Review Act (SEQRA) and privacy issues. Provide legal advice, direction and representation regarding toll-related procurement matters including contract drafting, solicitation, award, administration and claims. Review, research and handle complex legal issues, recommending and pursuing courses of actions and solutions to protect TBTAâ€™s interests and withstand judicial and/or administrative scrutiny. Must have Juris Doctor Degree from and accredited law school and New York State Bar Admission, maintained in good standing throughout employment. Should have 5 years of litigation experience in New York State court and/or, federal courts or administrative tribunals preferred. Must be experienced in procedural/substantive areas of law relevant to:public sector law, regulatory, environmental, contractual and/or enforcement, as well as state and federal consumer protection laws, rules, regulations and procedures. Criminal law and/or law enforcement experience desired.
