Senior Deputy Counsel - Affiliates
The candidate will work with client groups to develop a collaborative relationship and to understand their business unit strategies, goals, and priorities, as well as their culture and risk management standards. Maintain an awareness of applicable laws and regulations as well as industry and market best practices to contribute ideas and efforts to the achievement of strategic and business goals. Ensure IHA business units and affiliates receive appropriate legal counsel and services through an in-house legal team or outside legal counsel in areas of responsibility. Research legal cases and issues as needed. Draft, review, and approve contracts and documents for signature by the applicable department Executive team member or delegate. Review proposed state and federal rules and regulations and provide analysis regarding the same. Draft correspondence, memoranda, briefs, etc., concerning legal issues. Represent legal department at assigned committee meetings as assigned by General Counsel. Represent IHA and other entities by attending various Boards, Committees and staff meetings as directed by General Counsel. Participate in negotiations, including with government regulators, employer-sponsored group health plans, pharmacies, and drug manufacturers. Operate in a leadership position when developing and drafting position statements, arguments, and responses to regulatory and other outside inquiries or demands.

Qualification and Experience

The candidate should have a Juris Doctor Degree, be admitted to practice law in New York State. Must have 6 years of law firm experience/in-house counsel experience with the health law, employee benefits law, and/or pharmacy regulatory compliance. Must have knowledge of and familiarity with ERISA; Medicare Part D; State licensing requirements for pharmacy benefit managers and/or pharmacies; and State and Federal regulatory requirements for pharmacy benefit managers and/or pharmacies is desired. Must have proven ability to negotiate and work with clients on various forms of agreements and contracts, including administrative services agreements, business associate agreements, data sharing agreements, participating pharmacy agreements, and drug manufacturer pricing agreements. The ability to assume a leadership role and maintain client confidence is required. This includes the ability to understand business objectives and to provide legal advice in a business context. Must have legal research experience with excellent written and oral communication skills, strong interpersonal and negotiation skills. Must have a strong academic background. Knowledge and experience in dealing with Federal and State regulatory entities are needed. Be passionate, Caring, Respectful, Trustworthy, Collaborative, and Accountable.
