Attorney - SES The candidate renders legal advice and counsel to Division personnel including, the Director of the Division of Securities, and all bureaus and administrators on Division policies and regulations, legislative matters, statutory interpretations and rule promulgation, which require significant legal experience and the exercise of independent judgment. Conducts litigation in the representation of the Division of Securities. Responsible for the preparation of pleadings in anticipation of trial or administrative hearing, preparing appropriate motions and discovery, and presenting evidence and argument in state courts and administrative hearings and in federal courts. Conduct independent and varied legal research requiring significant legal experience and the exercise of independent judgment in evaluating state statutes, federal statutes and constitutional issues. Prepare legal opinions and memoranda for use within the Division of Securities. Assist attorneys, law clerks and support staff, as assigned, in their work functions and will be required to provide such persons with counsel, advice and suggestions so that a superior work product may be obtained. Drafts major contracts, agreements or documents regarding matters within the jurisdiction of the Division of Securities and advises the Division concerning compliance with applicable state and federal laws as to documents drafted within the Division or received from outside sources. Provides cooperation and assistance to Assistant State Attorneys, Assistant Statewide Prosecutors, Assistant U.S. Attorneys and law enforcement agencies concerning all criminal enforcement matters which may result from investigations conducted by the Division of Securities into alleged violations of the state securities laws or related statutes. Provide cooperation and assistance to other state and federal governmental agencies concerning civil or administrative actions related to alleged violations of the state securities laws or related statutes. Must have Doctor of Jurisprudence degree from an American Bar Association (ABA) accredited law school. Membership to the Florida Bar must be attained within twelve (12) months of appointment.
