Staff Attorney The candidate will provide assistance in the area of SPED law, including but not limited to: advise staff and attend ARD meetings; assist with preparation, review, and interpretation of IEP documentation; receive, review, process, and coordinate responses to all requests for due process hearings, request for TEA mediations, and notices of TEA complaint investigations. Work with General Counsel and SPED administration to assign SPED legal matters to retained counsel, as needed. Coordinate wall aspects of representation in SPED matters. Communicate and coordinate with parent advocates and legal representatives in SPED matters. Communicate efficiently and professionally with staff to resolve issues. Assist with grievances, Public Information Act requests, student records requests, and subpoenas related to SPED matters. Stay current and knowledgeable with all laws, rules, and regulations related to SPED, including the IDEA and Texas Administration Code, attend relevant workshops, training, conferences, and reading professional literature. Advise the Superintendent, designated staff, and Board on legal issues, including personnel and student issues, under the direction and guidance of General Counsel. Prepare and conduct litigation and represent the district in administrative and judicial proceedings. Draft, review and revise legal documents. Attend meetings as requested, including: Board meetings and other administrative meetings to provide legal counsel to the Superintendent, Board of Trustees, or designated staff. Coordinate legal services provided by outside law firms, including administering contracts and reviewing billings. Provide legal assistance to district’s hearing officer(s) for applicable student, parent, community member and employee grievances, complaints, and appeals as required by policy. Ensure District compliance regarding all applicable state or federal laws. Supervise and coordinate compliance with the Texas Public Information Act. Monitor compliance with the Texas Open Meetings Act. Monitor compliance with competitive procurement and purchasing contract requirements. Provide legal analysis regarding the formulation and execution of existing and/or proposed policies, regulations, and review materials for publication in associated manuals and/or handbooks. Coordinate responses to investigations by the Texas Education Agency, U.S. Department of Education Office for Civil Rights, and other administrative or regulatory agencies, as appropriate. Monitor and interpret the impact of proposed or enacted legislation. Conduct professional development training, including preparing training materials for staff, employees, and Board members. Provide legal assistance in the compilation, maintenance and filing of all computerized and physical reports, records, and other documents required by regulation, policy and/or law. Work collaboratively with District administrative staff and provide legal assistance to ensure compliance with policies and/or rules established by federal and state law, State Board of Education rule, and local Board policy. Demonstrate regular and prompt attendance. Perform other duties as assigned. Should have doctor of Jurisprudence degree from an accredited university. Must be licensed to practice law in the State of Texas. Should have experience in school law, preference for experience in special education law. Must have experience with administrative hearings and processes.
