Deputy Attorney General Iii
The candidate handle all phases of complex, sensitive, and difficult cannabis licensing litigation, including administrative hearings for appeals from denials of applications for cannabis licensure, prosecution of disciplinary actions against cannabis licensees, appeals of citations and cannabis license reinstatement, probation, modification, and termination cases; injunctive proceedings against cannabis licensees and unlicensed individuals, Penal Code section 23 hearings; and review of cannabis licensing agency decisions, including through the California appellate courts. Prepare for and represent agencies in several administrative hearings each month. Handle judicial review proceedings arising out of administrative litigation, through the Cannabis Control Appeals Panel and the California appellate courts. Handle other complex, sensitive, and difficult civil matters, including subpoena enforcement and defense, and defending client agencies in state and federal civil actions Apply sound legal judgment and abide by professional ethics. Act in lead capacity in team assignments with other deputies and paralegals. Work with investigators to obtain and develop evidence. Advise client agencies on legal matters, including settlement options, expert and/or consultant needs, and strategy, as well as provide training to agency staff. May serve in role as liaison to an assigned cannabis licensing client agency.

Qualification and Experience

The candidate dedication to consumer protection, strong civil litigation background with expertise necessary to capably handle complex, sensitive, and difficult work of the CCS on an independent basis for client agencies, and a working familiarity with principles of administrative and constitutional law, rules of evidence, and the administrative adjudication process set forth in the California Administrative Procedure Act (Gov. Code section 11340 et seq.) are highly desirable qualities. Must possess excellent research, writing, and advocacy skills, exhibited by recent and frequent drafting of pleadings, motions, and briefs; the ability to analyze difficult and complex legal problems, apply precedents to new factual scenarios, and present statements of fact, law, and argument clearly and logically in written and oral form are highly desirable qualities. Should have strong trial and oral advocacy experience, including recent and frequent experience conducting proceedings in administrative, trial, and appellate courts, preparing for and representing clients in administrative hearings and/or civil or criminal trials, handling review of lower court actions through judicial review, including appeals in the California appellate courts, and successfully negotiating settlement of actions informally and in mediation or settlement conferences are highly desirable qualities. Should have demonstrated ability to efficiently and effectively manage a large caseload, handle cases independently, and work primarily via computer with excellent computer skills (including electronic case management and electronic time keeping) in a multiple of programs are highly desirable qualities. Must have strong interpersonal communication and collaboration skills; ability to build and maintain good client relations; and the ability to interact positively and effectively with client representatives, subordinates, opposing parties, and counsel, and all members of the Attorney General’s Office are highly desirable qualities.
