Menlo Park office of a BCG Attorney Search Top Ranked Law Firm seeks a senior data protection and IP transactions associate attorney with 5+ years of direct experience for the data protection team within the growing intellectual property transactions (IPT) practice. The candidate must have strong data protection and technology transactions background and be enthusiastic about the firm's transactional practice. Must have an interest in technology and have solid experience in the data protection aspects of corporate transactions. Should have had experience managing junior associates and support staff, have been the subject matter experts in a large deal team, and be used to working with multiple competing client deadlines. Should have 5+ years of law firm experience focused on data protection and cybersecurity advice; experience drafting and negotiating technology, licensing and commercial contracts involving data use; experience drafting and editing privacy notices, terms of service, incident response plans, information security policies and other data protection policies; familiarity with large, fast moving capital markets and M&A transactions, with a focus on M&A due diligence, negotiating data, privacy and security representations, cross border data transfers, indemnities and other deal critical terms; experience with developing global privacy programs, and with compliance with CCPA, CPRA, GLBA, CAN-SPAM, HIPAA, GINA, FERPA, GDPR, ePrivacy Directive, PIPEDA; UK Data Protection Regulation, Japan Data Protection Regulation and other global privacy laws and regulations; and a strong working knowledge of privacy and data security laws on a federal and state level relating to the healthcare and financial industry. Should have had solid experience responding to security incidents and handling data breaches, responding to regulatory investigations, and incident-related litigation. Certified Information Privacy Professional (US and EU) is preferred. Admission to practice law in California is essential.
