Malone Consultants Group is recruiting for a Northwest Arkansas law firm located in Fayetteville, AR. This banking and finance attorney will provide legal support and advice to banks and financial organizations about regulations, contracts, and other finance issues. The attorney's role includes the critical review, drafting, and negotiation of secured credit agreements, collateral documentation, control agreements, and ancillary documents for financing transactions and managing, preparing for, and executing all aspects of litigation. This attorney will need experience representing creditors in bankruptcy and probate proceedings as well as general knowledge of matters involving the representation of financial institutions, with tax experience preferred. Most importantly, this attorney will exemplify the firm’s culture and ethical standards. 

While banking and finance work will be the primary focus of this position, the Banking and Finance Attorney will also be responsible for representing other clients in a variety of business matters and civil litigation.

This attorney will review, draft, negotiate, and advise clients on all aspects of our clients’ businesses, with guidance and support from the firm's senior members while working closely with other team members on a frequent basis. This firm works in a collaborative manner with support from law clerks and office administrators.

Here are a few key responsibilities for this role: 

  • managing actual and potential litigation and enforcement matters, including reviews and investigations related to such matters;
  • advising on contract negotiation and documentation;
  • interpreting existing laws, rules, and regulations, and advising on changes to such;
  • all aspects of advice regarding routine commercial lending work, including cash flow lending, acquisition finance, and asset-based loan transactions;
  • debt collection and foreclosures;
  • drafting and advice regarding all loan related documents, including credit agreements, security agreements, indemnities, UCC's, guaranties, subordination agreements, and affirmation agreements; and
  • preparing for and attending hearings, trials, creditor meetings, and other proceedings for all bank clients; and
  • providing a weekly summary of projects and anticipated work for the following week.

Seeking candidates with these qualifications: 

  • Law Degree/Juris Doctorate-required
  • Attorney must be licensed to practice law and a member in good standing in Arkansas (will consider reciprocity assiistance)
  • At least 5 years in a law practice with a focus on creditor matters
