Lawyer Responsibilities: Provides overall support for the wide variety of legal issues administered by the Department, including Workers Compensation, Unemployment Insurance, Wage and Hour, Human Rights, Independent Contractor, Safety, and Workforce Development matters. Serves as the main resource for the Department's internal Human Resources Office and supports the Department's core values through HR matters. Represent the Department in all areas of law enforced by the Department. Advise the Human Resources office as needed on disciplinary matters in all divisions. Represent Boards administratively attached to the Department. Appear in state and federal courts as well as administrative tribunals, within the department, within state government, as well as federal agencies, as necessary. Coordinate actions with other attorneys within the department, within state government, as well as federal agencies, as necessary. Be required to be able to be certified as a Special Assistant Attorney General and to appear on behalf of the department on criminal prosecutions.
Qualification and Experience
Qualifications: Candidate will have experience with ADA, FMLA, EEOC, WDEA and other HR issues. Knowledge of: Employment law including the Montana Wrongful Discharge from Employment Act, the FMLA, the Montana Human Rights Act, the ADA, and other laws pertinent to employers. Representation of public boards. The administrative rulemaking process. Skills in: Analyze and evaluate information and make sound judgments, exercise independence in judgment. Able both to write and speak clearly and persuasively on behalf of the Department. Conduct proper research into diverse areas of law and interpret and apply statutes, case law and precedents to assigned legal problems. Ability to: Establish and maintain effective working relationships with others. Be reliable and dependable by following through on commitments and meeting timelines. Prioritize work while balancing multiple goals and objectives under stressful situations.
