Staff Attorney II The candidate provides a variety of legal services for a state agency which are occasionally characterized by issues which are unique, controversial or technical in nature and require extensive research and analysis; and performs other duties as required. Provide legal guidance and co-lead investigations into state testing improprieties; assist in the preparation of recommendations to the Testing Board of Review; provide legal research and analysis regarding state testing anomalies. Drafts and reviews proposed legislation for the agency. Drafts and reviews proposed administrative regulations regarding complex agency issues. Provides legal guidance to staff on the implementation of the Commissionerâ€™s local board member appointment process. Provides legal guidance to the Kentucky Department of Education (KDE). Represent the Kentucky Department of Education in pending administrative and court cases. Assists the agency head and general counsel with implementation of executive branch ethics code requirements and federal statutes prohibiting discrimination through the agencies Unified Compliance Plan, and consults with the Office of Civil Rights as needed. Review legality and form of agency and local district contracts, memoranda of agreement, and personal service contracts as required by statute. Provide consultation by phone, email and interview to KDE and Local Educations Agencies (LEA) staff, other agencies, parents, professional organizations on legal issues and interpretation of school laws. Conduct legal research and write memorandas on interpreting statutes and providing guidance on complex school law questions. Attend meetings to provide legal counsel as needed. Collaborate on interagency and cross agency projects as needed. Presents information at outside conferences, meetings and Continuing Legal Education (CLE) events related to legal issues related to the agency. Perform other duties as assigned. May coordinate the work of other attorney and non-attorney staff. Should have 1 year of experience as a licensed attorney in the practice of law. Master of Law degree will substitute for the required experience. Must be licensed to practice law in the Commonwealth of Kentucky or comply with SCR 2.111 Limited certification of admission to practice or SCR 2.112 Attorney participants in defender or legal services programs.
