Employment Attorney The candidate will be responsible for day-to-day legal advice and guidance related to labor and employment matters and general risk management employment law related guidance to company's broker/dealer, investment management and shareholder servicing businesses. Will have regular interaction with senior management and coordination with business units. Be recognized as an expert within the company, providing well-reasoned, concise counsel, while balancing business oriented goals with legal/regulatory risk. Inspire confidence through the strength of intellect, judgment and ability to manage interpersonal relationships at all levels. Provide in-house legal services and support to all areas of company, its subsidiary and affiliated companies. Primary responsibility for legal advice to Human Resource representatives and Company managers on a wide range of employment law matters, including, but not limited to, employee relations, recruiting, hiring, training, performance management, leaves of absence, requests for accommodation, wage and hour compliance, compensation structure/plans, exemptions, independent contractor status, and other industry related employment topics. Provide legal guidance to Human Resources clients on review, drafting and implementation of employment policies, procedures and written guidelines. Provide legal guidance to Human Resources clients on establishment of employment related processes and creation of standard templates. Direct and provide legal counsel for internal Company investigations for all business units, including, but not limited to, matters related to violation of Company employment, personnel and general business policies. Coordinate, prepare and oversee responses to demand letters and agency complaints and audits (EEOC, DOL, etc.) regarding employee status, tax and compensation matters and handle related investigations. Provide advice and draft a variety of employment related agreements, such as offer letters, employment agreements, restrictive covenants, separation agreements, contractor agreements, etc., and advice on reorganization as needed. Supervise and provide guidance on Company responses to unemployment and workers compensation claims. Assist in enforcement of contractual, regulatory and legal obligations of departing Company personnel. Stay abreast of new employment related legislation and requirements and provide guidance to assist Company leaders with compliance. Identify and minimize legal exposure by identifying areas of legal risk and participating in the privileged audit of company functions. Educate business partners through presentations and advice on employment law topics to mitigate legal risks across the organization. Work on legal projects to improve business policies and processes, as necessary to mitigate legal risks. Take steps to preserve the privileged nature of advice provided to all company clients. Assist in responses to regulatory and complex third party subpoenas. Assist, as requested, in management of Company employment related administrative claims, litigation and arbitration matters. Work with clients to execute on legal guidance provided by supervising Associate General Counsel and Company's General Counsel. Assist in legal projects, as assigned.
Qualification and Experience
The candidate should have a J.D. degree from an accredited US law school with excellent academic qualifications. Should be a current member in good standing on at least one State Bar with ability to obtain licensure in Kansas. Must have 6+ years of experience in employment law counseling, with exposure to managing employment litigation. Should preferably have 6+ years of experience with a large law firm or Fortune 500 Company law department. Class rank in the Top 20% from an accredited US law school and law review preferred. Experience in securities law, mutual fund or financial services industry, including FINRA arbitrations is an asset. Counseling experience and strong knowledge of state and federal laws, including, experience in risk mitigation in all areas of employment law required. Should have ability to travel, as needed.
