Attorney II
The candidate performs responsible and complex professional level legal work involved in the performance of professional legal services included in criminal and civil investigations,(juvenile and adult) dependency investigations (child welfare), trial preparations, prosecutions, defenses and/or non-trial resolutions. Positions at this level are normally filled by advancement or progression from the Attorney I level or, when filled from outside, requires prior successful, increasingly responsible Attorney experience in prosecution or defense. Work involves performing legal services at the full performance level of professional difficulty and requires the application of learned judgment and technical proficiency in the completion of assignments. Attorney II positions are assigned to work in the Legal Advocate, Legal Defender, Public Defender, or County Attorney Office. Reports to: Higher level of authority and requires independent decisions in accordance with established procedures. May exercise technical supervision over clerical support and paralegal personnel. In certain situations may be asked to coordinate and mentor newer, less experienced attorneys within a work group. Prosecutes or defends all stages of misdemeanors and felonies, which may include major felonies and juvenile cases. As a prosecuting or civil attorney, represents the County in civil cases initiated by or against the County. As a Legal Advocate represents children in dependency (child welfare – abuse and neglect) cases. Public Defender and Legal Defender represent parents in dependency cases who are facing removal of their children following filing by the State of a court petition alleging parental abuse or neglect. May be assigned to represent children in unrelated juvenile delinquency cases. Prepares and presents State's evidence in criminal and civil actions to include legal arguments regarding Personnel Policies and Procedures, and Department Regulation. Argues on behalf of the State against writs of habeas corpus, petitions for post-conviction relief and motions to suppress evidence. Prepares appropriate defense which addresses the legal principles involved. Appears on behalf of the State in, or defends, probation revocation hearings and sanity hearings. Prepares and oversees the preparation of legal briefs and memoranda. Negotiates with opposing counsel on appropriate disposition of cases. Writes appellate briefs and argues appeals before the Supreme Court in behalf of indigent clients.Negotiates pleas in criminal cases in behalf of indigent clients. Interviews victims, witnesses, clients or prospective clients in the office, in custody and in other environments as necessary. Performs legal research in connection with legal writing and legal arguments. Receives and evaluates reports and discovery materials from various entities which may include Department of Child Safety and mental health providers. Orders investigations, subpoenas and retained expert evaluations. Communicates with civic and governmental agencies regarding rehabilitation programs for clients. Provides advocacy at sentencing proceedings. Works with the Probation Department on probation with clients. Handles probation revocation hearings. Works with Attorney General, case managers, mental health providers, foster parents and others involved in the lives of dependent client's. Attends and participates in Child Family Team Meetings and case plan staffings for dependent clients. Conducts in-person visits with dependent clients, including but not limited to foster parents, schools, and kinship placements. Communicates and acts in a professional manner with the public, co-workers, and work contacts. Performs special assignments as requested. Performs related work as required.

Qualification and Experience

The candidate should have admission to the Bar of the State of Arizona, or eligibility for admission by Arizona Supreme Court Rule 38(g). Must have 1 year of progressively responsible experience in professional legal work. Must have demonstrated trial skills through performance of both bench and jury trials at a minimum of the Justice Court level, Superior Court experience is preferred OR any equivalent combination of education, experience, and training which provides the required knowledge, skills and abilities will be considered in meeting the minimum qualifications. Should have possession of a certificate of admission to the Bar of the State of Arizona. (May be hired prior to admission, but at a lower pay rate until full admission is obtained). Must have knowledge of: Principles of civil, criminal, juvenile, and juvenile dependency law, and of the methods and practices of pleading and trial advocacy. Judicial procedures, rules of evidence, rules of criminal procedure, and rules of juvenile procedure, especially Arizona rules. Superior and Juvenile Court policies and procedures. Principles, methods, materials, practices, and references utilized in legal research and presentation. Terminology common to forensics, psychology, child abuse/neglect, domestic violence and substance abuse. Interviewing and investigative techniques. Arizona Supreme Court rules of Professional Conduct. Mohave County Personnel Policies and Procedures, and Department Regulation. Should have ability to: Analyze, appraise and organize facts, evidence and precedents and to effectively present such materials in writing and orally. Understand and interpret constitutional provisions, statutes, administrative regulations and precedents. Understand, interpret and apply pertinent federal, state and local rules, regulations, procedures and policies regarding legal work and services to include departmental procedures and requirements. Read, interpret and apply technical materials encountered as a result of work assignments. Manage problems which may be controversial or sensitive in nature. Prepare, present and conduct trial defenses and appeals effectively. Determine alternative courses of action. Present and argue cases in court and handle unanticipated problems smoothly. Communicate effectively both orally and in writing with persons of diverse ethnic, educational and economic backgrounds. Maintain objectivity and freedom from prejudice. Maintain confidentiality. Understand and grasp ideas quickly and follow instructions with initiative and exercise good judgment. Communicate clearly and concisely, both orally and in writing. Maintain accurate and up-to-date records and documentation. Establish and maintain cooperative working relationships with those contacted in the course of work. Perform the essential functions of the job specifications with or without a reasonable accommodation. Comply with Mohave County Personnel Policies and Procedures, and Department Regulations.
