Legal Counsel II The candidate will collaborate with business partners at all levels of management to effectively balance minimizing legal risk while enabling execution of business strategic objectives. Will partner with the sales and marketing organizations, providing strategic counsel on the intersection of business and legal issues. Will provide general commercial legal support to Diabetes commercial teams, for example, sales, marketing, customer service, and managed markets. Provide legal support on other Diabetes Group and enterprise needs and matters as assigned. Provide guidance on the design, development, and implementation of sales and marketing programs for medical devices and/or services. Interpret and guide on payer agreements, programs, and negotiations. Responsible for General counseling on business operations in various areas.
Qualification and Experience
The candidate should have a J.D. degree from an accredited US law school and admission to State Bar. Must have 5+ years of legal experience. Should preferably have 8-10 years of relevant legal experience as corporate/commercial/healthcare attorney. Should have experience with contracts (e.g., strategizing, structuring and negotiating). Experience with government healthcare programs and commercial insurance providers is required. Experience with privacy laws and HIPAA is needed. Experience with healthcare and/or healthcare law, including Federal Healthcare Fraud and Abuse Laws (including False Claims Act, Anti-Kickback Statute, and Civil Monetary Penalties Law) is essential. In-house experience with a medical device, healthcare, or life sciences company is desired. Experience advising senior level executives (Senior Directors, VPs, and above) is an asset. Admission to California State Bar is preferred.
