Senior Attorney The candidate will be providing legal analysis to staff of the Office of the Inspector General in DHS regarding the administration of statutes and rules governing the Minnesota Health Care Programs (MHCP), Child Care Assistance Program (CCAP) and other public benefit programs administered by DHS. Will be negotiating with providers and their legal representatives to obtain voluntary compliance with statutes and rules, and to reach agreement regarding the action to be taken by the Department as a result of the investigative findings. Coordinating the referral of complaints, cases, or case findings to the appropriate entities. Acting as liaison between FFAID and other divisions of the Department, the Attorney General's office, Medicaid Fraud Control Unit, County Attorneys' Offices, United States Attorney's office, HHS/Office of Inspector General, and licensing boards. Developing and drafting legislation, rules, memoranda of understanding, contracts, data-sharing agreements, inter-agency agreements to support FFAID/OIG and program integrity functions. Coordinate data practices, media and legislative requests received by FFAID/OIG.

Qualification and Experience

The candidate should be currently licensed to practice law in the state of Minnesota and has possessed licensure for 3 years. Must have 3 years of professional experience as a practicing attorney demonstrating the following: Litigation experience in Criminal, Civil, and/or Administrative law; Experience with dispute resolution either civil or criminal. Must have extensive knowledge and experience with data privacy law and regulation, including to the Minnesota Government Data Practices Act and the Health Insurance Portability and Accountability Act. Experience providing legal advice to legal staff, division staff, senior management or executives, and stakeholders is required. Experience with oversight of Medicare or Medicaid health care services or other public assistance programs, or other experience with compliance under health care or public assistance programs is preferred. Experience working for a government agency/organization is preferred. Knowledge and experience in the state legislative process, including drafting and/or reviewing proposed legislation is required. Knowledge and experience working with Managed Care Organizations is required. Knowledge of Medicaid Integrity Program is required. Experience with CMS regulations relating to the provision of Medicaid Services is required.
