Profile

Workers' Compensation Judge The candidate will preside over trial matters, admit evidence, rule on objections and prepare a clear record of the presented case; issue decisions in a timely manner as prescribed by statutory, regulatory and case law and the evidence presented; prepare reports to the Reconsideration Unit as required; confirm that the record and all documents are properly entered into the Electronic Adjudication Management System (EAMS). Adjudicate through the mandatory settlement and conference calendar those cases that are presented and assist the parties in resolution by mediating matters in dispute and setting cases for trial which are not resolved; review documents presented as a walk-through including settlements and various petitions and issue orders related thereto; review and research those areas of law which are presented to the judge. Review, analyze and research to decide law and motion matters, and settlement requests, as well as requests from litigants as presented through EAMS and issues orders related thereto. May be requested to act as the Acting Presiding Workers' Compensation Judge when the Presiding Workers' Compensation Judge is absent from the office. Keep current and up-to-date on case law, statutory law, rules and regulations, rating schedule, departmental policies, and the policy and procedure manual; perform other job-related duties as assigned.

Qualification and Experience

The candidate should have membership (active or inactive) in the State Bar of California. Should be licensed to practice law in California for five or more years, at least two years of which shall be as an attorney serving on the staff of the Division of Workers' Compensation or Workers' Compensation Appeals Board in a class with a level of responsibility equivalent to an Industrial Relations Counsel. Or Licensed and experience in the active practice of law* in California for five or more years, in litigation before a trial court or quasi-judicial body involving the interests of adverse parties, at least three years of which shall be in workers' compensation law. Or licensed and experience in the active practice of law* in California for five or more years, experience in workers' compensation law, at least three years as presiding officer in a judicial or quasi-judicial body; or as a member of a court conducting judicial proceedings; or an administrative body conducting quasi-judicial proceedings; or as a hearing officer. Should have experience performing legal research, experience participating in hearings in a manner that will obtain all pertinent evidence and secure the confidence and respect of all parties, experience analyzing and appraising legal problems, and applying legal principles and precedents to a particular set of facts, experience making accurate summaries of evidence and preparing appropriate findings, awards, orders, and other legal documents relating to compensation litigation, experience analyzing situations accurately and adopting an effective course of action, experience communicating effectively at a level required to perform the essential functions of the job, experience with computer programs including Microsoft Office, ability to work in a busy office environment for an eight-hour workday, ability to get along with others, ability to work independently, ability to make a timely decision. Should have knowledge of principles and provisions of the Labor Code and regulations pertaining to workers’ compensation insurance and safety, of leading court decisions on the subject of California Workers’ Compensation Law, knowledge of how to conduct court proceedings, of rules of evidence governing such proceedings, and laws relating to serving notices, taking depositions, and issuing subpoenas, of medical, physiological, anatomical, and occupational terminology in relation to cases of industrial injury, of the purpose and organization of the Workers’ Compensation Appeals Board and Division of Workers” Compensation, knowledge of procedures before the Workers’ compensation Appeals Board, knowledge of legal research methods and performing such research, of the underlying philosophy of workers’ compensation legislation, of the California Code of Judicial Ethics. Should have excellent listening skills to give full attention to what other people are saying, taking time to understand the points being made, asking questions as appropriate, and not interrupting at inappropriate times, excellent writing skills understanding written sentences and paragraphs, spelling and grammar, excellent communication skills both verbal and written, decision-making skills and problem resolution skills, using logic and reason to identify the strengths, and weaknesses of alternative solutions, conclusions, or approaches to problems, excellent organizational skills to be able to prioritize work and ensure that decisions are issued timely. Should have knowledge of code of Judicial Ethics Principles and provisions of the Labor Code pertaining to workers' compensation insurance and safety; leading court decisions in California and the United States Supreme Court on the subject of California Workers' Compensation Law; conduct of proceedings in a trial court, rules of evidence governing such proceedings, and laws relating to serving notices, taking depositions, and issuing subpoenas; medical, physiological, anatomical, and occupational terminology in relation to cases of industrial injury; purposes and organization of the department and specific units; procedures before the Workers' Compensation Appeals Board; legal research methods and performing such research; and underlying philosophy of workers' compensation legislation. Should have the ability to perform legal research; conduct hearings in a manner that will obtain all pertinent evidence and secure the confidence and respect of all parties; analyze and appraise legal problems, and apply legal principles and precedents to particular sets of facts; make accurate summaries of evidence and prepare appropriate findings, awards, orders, and other legal documents relating to compensation litigation; analyze situations accurately and adopt an effective course of action; speak and write effectively, and communicate effectively at a level required to perform the essential functions of the job.
