Philadelphia office of our client seeks attorney with 4-6 years of litigation experience to work on ERISA litigation matters. The candidate should have significant experience in class action and single plaintiff litigation under ERISA involving defined-contribution and defined-benefit retirement plans, including claims for breaches of fiduciary duty including prohibited transactions, benefits denials, indemnification, contribution, subrogation and reimbursement. Must have clear understanding of ESOPs, 401(k) and 403(b) Plans, ERISA's prohibited transactions provisions and exemptions, and the typical claims, audits and investigations brought by the U.S. Department of Labor, the IRS and the Pension Benefit Guaranty Corporation. Large law firm benefits experience is preferred. Must also have experience in: Analyzing and researching case law regulations; Preparing pleadings, motions, memoranda, briefs and other court papers such as motions to strike, motions to dismiss, motions for summary judgement, motions for reconsideration, answers and affirmative defenses, and pre-trial submissions, trial and post-trial motions; Preparing and responding to discovery requests, including working with clients to draft answers to interrogatories and requests to admit; Supervising document collection and production, including ESIG; Taking and defending depositions; Representing the firm's clients in court.
