Oversees compliance investigations and provides direction for processing and evaluating internal inquiries and allegations and external complaints, and for conducting investigations of compliance matters across all business areas. Collaborates with colleagues in the Corporate Compliance Department to identify risk areas and develop compliance plans and program enhancements to address areas of risk. A Compliance expert on application of external regulations and requirements to key activities and the development, enhancement and implementation of key compliance processes, policies, procedures and systems. All incumbents are responsible for following applicable Division & Company policies and procedures. Scope of Authority - span of control (work unit, site, department, division, etc.), monetary value of budget/spend authority ( capital, operating, etc.), P&L responsibility, etc. Enterprise-wide for ex-U.S. markets and U.S. generics. Key Accountabilities - key outcomes/deliverables, the major responsibilities, and % of time Accountability Responsibilities % of Time Oversight of Compliance Activities In consult with the Chief Compliance Officer, oversee the international and generics compliance programs and activities to ensure alignment with business goals and objectives. Supports the Chief Compliance Officer and Senior/Executive management in meeting enterprise and business unit goals and objectives. Identifies Compliance risk areas and develops strategies to address risk areas. Co-chairs regional compliance committees based on risk profile. 25% Investigations, Auditing & Monitoring Reviews and conducts compliance investigations and ensures appropriate resolution and, corrective action, if any; monitoring of relevant commercial and research activities and due diligence and ongoing monitoring of 3rd party agents. Responsible for the initial assessment of allegations and reporting of compliance-related complaints. Prepares periodic reports findings/conclusions for Endo’s Chief Compliance Officer, management team, and Endo’s Compliance Committees. 25% Leadership & Collaboration Serves as a leader across the company on international compliance and investigations. Establishes a governance model to support implementation of an effective international compliance program at global, regional and local level including establishing and maintaining a network of compliance champions. Collaborates with business and compliance colleagues and provides leadership for key compliance initiatives. Drives implementation/modification to global policies and establishment of global, regional or local procedures, processes or systems. 20% Planning, Program and Policy Development, and Reporting Provides oversight for the development and execution of the annual compliance auditing and monitoring plans for the international and generic businesses; corporate and international policy development; and identifies program enhancements to address compliance risk areas. Responsible for reporting international and generics metrics and key performance indicators that reflect the effectiveness of the international and generics compliance program to the Chief Compliance Officer. 15% Training Develops, coordinates, and delivers training sessions (live, WebEx, and written formats) that focus on the core elements of the compliance program and key risk areas. 10% Due Diligence Provides guidance assessing business risks and the control environment during due diligence for generic and international acquisitions. 5% Total 100% Qualifications Education & Experience Minimal acceptable level of education, work experience and certifications required for the job Bachelor’s Degree required with 10 years of compliance, legal and/or forensic accounting/auditing field. Strong educational credentials with an advanced degree such as JD, Accounting degree, CPA and/or CFE preferred. Knowledge Proficiency in a body of information required for the job e.g. knowledge of FDA regulations, GMP/GLP/GCP, Lean Manufacturing, Six-Sigma, etc. Knowledge of U.S. Foreign Corrupt Practices Act and other global anti-bribery laws and country specific regulations, industry guidelines and other requirements relevant to the Company’s Compliance Program, including government price reporting laws, fraud and abuse and anti-kickback laws, PDMA, OIG and IFPMA, Eucomed and PhRMA guidelines, international and U.S. transparency laws. Knowledge of and experience with corporate integrity agreements and deferred prosecution agreements strongly preferred. Ability to evaluate complex health care compliance issues and make appropriate recommendations. High analytical thinking with demonstrated talent for identifying and analyzing critical risk areas. Demonstrated excellence in writing investigative reports. Able to prioritize and align the organization against goals and objectives; ensures rigor in operational excellence; and focuses on outcomes with clear measures and metrics. Ability to build and manage relationships with business partners and Compliance colleagues. Ability to project leadership and influence without authority. Physical Requirements Physical & mental requirements e.g. lift 40 pounds, walk across plant/warehouse, business travel (% of time), driving as part of work responsibilities, etc. Business travel up to 25% of time.
