AVP Managing Counsel Coverage Candidate will: (1) manage a team of approximately six attorneys that accept referrals of complex coverage matters and other claim-related legal issues from CNA’s Claim organization and, more specifically, from the GL, Environmental and Mass Tort Claim/Asbestos, Life Sciences, and Construction Defect disciplines; and (2) directly handle an inventory of the most complex/high profile referrals in these disciplines. In this role, you may also provide assistance in other lines of business, including Specialty and, from time to time, 1st Party lines. As a managing attorney and member of our claim legal team, you will have responsibility for both directly providing and ensuring your team’s provision of industry leading legal research and analysis of complex coverage issues, strategic guidance, recommendations, and periodic support for training initiatives and other special projects. You will also use and develop data concerning the team’s output to provide analysis of performance and trends to senior leadership. Leads and directs the work activities and has full management responsibility for the performance of assigned staff attorneys. Exercises full management authority, including performance reviews, pay decisions, recruitment, discipline, termination and other personnel actions. Assigns work to commercial counsel, legal analyst, and support staff, monitors work, and coordinates with others as needed. Optimizes talent in accordance with CNA’s needs and expectations, driving desired behavior and superior results. Manages, oversees, and/or directs coverage litigation. Provides strategic counsel and advice to Claim and Underwriting professionals with respect to the impact of coverage and other claim related legal issues on overall claim exposure. Identifies and assesses risks, collaborating with/across Claim professionals, strategic coverage teams, and the coverage litigation firm. Maintains enterprise perspective and identifies critical strategies and priorities. Drives effective research and analysis of coverage and other legal issues for Claim and Underwriting professionals in non-litigated matters. Assures that timely advice is provided in appropriate form under the circumstances. Creates a culture that embraces effective early resolution of disputes by assessing and addressing each side’s needs to obtain a reasonable level of satisfaction with the outcome under the given circumstances. Coaches and mentors individual team members to anticipate, recognize, and deal effectively with existing or potential conflicts at the individual, group, or situation level. Consistently models “can do” attitude and commitment to provide first-class service to our customers and best-in-class legal support to our internal clients and colleagues. Directs ongoing formal and informal individual and group business-line-specific coaching/ training to Claim leaders, Claim professionals, underwriting, and/or brokers/agents. Educates key stakeholders (customers, claimants, other insurers, mediators, etc.) about coverage and other claim related legal issues. Partners with Claim, Underwriting, and Product Development teams to develop, supplement, and revise policy language and participates in customer and claimant meetings, as needed, in partnership with Claim professionals and/or business partners. Makes informed strategic and operational decisions by identifying and analyzing trends and improvement opportunities through the effective use of resources, tools, and metrics. Responsible for the ongoing management of staff by attracting talent, setting clear direction, providing appropriate guidance, managing performance, recognizing contributions, and developing capabilities. Ensures quality by assuring compliance with best practices, and developing and delivering training as needed. Requires strong communication and diplomatic skills to guide, influence, and persuade others, particularly colleagues in other areas and/or external customers. Communicates regularly with leadership and staff regarding operational effectiveness, continuous improvement opportunities and results. Stays up to date on legal trends and developments as well as insurance industry issues, increasing overall insurance business acumen. May perform additional duties as assigned.

Qualification and Experience

Qualifications: Bachelor’s degree with JD, plenary admission to the bar of at least one state, and ability to satisfy any applicable in-house counsel licensure requirements. 10+ years of related work experience in claims and/or law firm with a progressively increasing level of responsibility, including demonstrated (direct/indirect) management/leadership experience and experience participating in/leading complex negotiations, mediations, or other alternate dispute resolution processes. Must include 8-10 years of experience, either in a substantial in-house position providing legal support for claims of the highest severity, or in a law firm providing legal advice and litigating third-party insurance claims of the highest severity and complexity. Must have prior experience as a third-party coverage attorney, be admitted to the bar of at least one state, have substantial experience providing in-house legal support and strategic counsel to claims staff and senior management in connection with third-party lines of business (principally GL, Environmental and Mass Tort/Asbestos, Life Sciences, and Construction Defect), and possess top-tier legal research, management, and communication skills and coverage acumen. Expert level of insurance coverage and policy interpretation knowledge. Superior insurance legal background. Ability to build and sustain beneficial relationships internally and externally. Ability to develop strong collaborative relationships with claim professionals. Excellent knowledge of the insurance industry and in-depth knowledge of Claim operations, policies, and procedures. Stays informed on relevant industry legal support changes and requirements. Excellent analytical and problem solving skills. Thinks creatively and uses diverse ideas to solve problems. Strong strategic orientation and business planning skills with the ability to develop clear claim/case specific plans aligned with business strategy. Ability to drive strategy and implement innovative solutions. Solid knowledge of and ability to use Microsoft Office and business specific software (Claim Center / TeamConnect / Adobe, etc.) effectively. Ability to understand and anticipate business technology needs and find robust solutions. Excellent communication, presentation, and negotiation skills (verbal and written). Ability to implement systems, processes, and procedures that improve the coverage operation and the client experience. Ability to train others and create sustainability and consistency across the organization. Defines meaningful metrics and uses information analysis and accesses technology resources as needed. Acts with a sense of urgency to advance priorities of the organization. Helps others to excel through collaboration and building strong relationships. Thinks creatively and uses diverse ideas to solve problems. Raises expectations of self and others by continuously learning and broadening industry and technical skills.
