Legal Counsel - Employee, Senior Manager The candidate will serve as an Employee Relations expert and ambassador of the positive employee relations philosophy, providing counsel and guidance to the HR function and business leaders for complex and escalated issues, such as policy interpretation, performance management, disability management, job eliminations and other terminations, conflict resolution, disciplinary actions, or other issues representing significant risk to the organization. Will counsel and advise the HR function, HR leadership and business leaders on the administration of policies and procedures in compliance with specific federal, state and local employment laws including but not limited to the FCRA, FLSA, ADEA, Title VII, ADAAA, FMLA, and NLRA. Lead the investigation and resolution of complaints of the highest complexity and sensitivity, ensuring investigations are conducted and recommendations are developed in an objective and thorough manner and prepare written reports of fact findings. Coach and develop 6 HR professionals accountable for employment investigations, claims and charges and resolution of complaints. Use data & analytics to identify trends and address barriers to positive employee relations. Apply a continuous improvement lens to enhance operational activities in the employee relations space. Manage HR vendors who supply employment law and employee relations services. Serve as a key link to the General Counselâ€™s office to maintain consistency in approach to employment law matters and to connect for mentoring and broader career planning. Review employment practices and procedures for effectiveness and compliance; develop and implement recommendations for process, practice and/or policy changes (for example, Alcohol and Drug Policy; Criminal Background Check Policy; Separation from Employment Policy and Process, etc). Identify ER trends within a business unit and collaborate with the broader HR function to identify necessary policy or process modifications. Lead and partner in the development and implementation of training initiatives to improve management capabilities related to effective employee performance management, conflict management and employment compliance practices. Operational activities may include: Lead continuous improvement initiatives to ensure services are effectively delivered. Ensure HR programs are developed with robust metrics defined so that they can be continually measured and improved over time. Identify and recommend methods to update, simplify and enhance processes, procedures and technologies. Analyze operational performance of HR programs against established metrics. Should have JD degree, licensed to practice law. Must have 10+ years of practicing employment law with some of this experience in a private practice setting. Experience practicing employment law in a global corporation is preferred. Experience in litigation is preferred. Experience leading investigation of complex and sensitive complaints and delivering appropriate recommendations is preferred. Experience leading the development and implementation of relevant training initiatives are preferred.
