Legal Operations Counsel (DCS) The candidate will provide legal advice and legal services to Central Office, County Offices and/or staff of DCS for legal matters, and to represent and assist the Agency in administrative and/ or court matters. Will aAssist the Deputy General Counsel and Chief Counsel of Legal Affairs in managing civil litigation, but not limited to, torts, civil rights, employment, contacts, and judicial review. Attending mediations and court dates as needed, supporting outside counsel with explanations of DCS policies and procedures, staying apprised of legal developments, monitoring of cases handled by outside counsel, and collection/preparation of discovery. Support the department’s Ethics Officer. Analyze requests for authorization of supplemental employment and waiver of post-employment restrictions; questions to the DCS Ethics mailbox regarding elections/elective office (Hatch Act), gifts, moonlighting, reports of ethics violations. This position may be considered as an option for being named as the agency's Ethics Officer in the future. Provide legal analysis of tort claim notices and collection of relevant documentation upon receipt of notices. Review requests for documents under Access to Public Records Act (APRA): Document Review and redact for production under APRA or FOIA. Provide legal support for confidential records team. Legislative, Administrative Rule, and Policy review and implementation: Analyze, review, draft, and suggest revisions laws, rules, and policy and assist with the implementation and advise staff accordingly. Provide legal support for staff inquiries as needed. Research and advice DCS staff on a broad array of topics including, but not limited to, confidentiality, HIPPA, FERPA, ICWA, immigration, citizenship, and foreign adoptions. Provide subject-matter expertise in Title IV-E eligibility and compliance with 42 USC §673 et seq. and Indiana’s IV-E state plans.
Qualification and Experience
The candidate should preferably have JD degree. Indiana Bar Admission; license in good standing is needed. Strong legal research, writing and litigation skills are essential. Strong communication and public speaking skills are needed. Should have 2+ years prior civil litigation experience.
