Legal Counsel, Global New Business Models and Healthcare Law Candidate will be part of a corporate, shared-service team of lawyers that combines deep substantive expertise in health law and healthcare compliance issues with a strong understanding of Medtronicâ€™s existing and emerging business models. Will advise commercial attorneys and business partners in each of Groups, Regions and Functions, and manage risk presented by applicable regulatory regimes, including the U.S. Anti-Kickback Statute and its safe harbors, the Physician Payments Sunshine Act, the Federal False Claims Act, Stark Law, and other laws and regulations pertaining to physicians, hospitals, clinics, and the delivery of healthcare around the globe. Will also provide legal advice to the Medtronic Office of Ethics and Compliance and Group and Regional compliance teams. Will also provide commercial legal support to particular emerging or specialized business units, as needed, including but not limited to Medtronic Care Management Services. Will report to the Senior Legal Director, Global New Business Models, Healthcare Law & Investigations. Identify, anticipate, counsel on and help mitigate key legal risks . Serve as a subject matter expert on fraud and abuse and healthcare compliance issues to build consensus and develop policy . Develop expertise on emerging and cutting edge legal issues facing the company. Provide day-to-day advice, counsel and training of commercial attorneys, business clients, and other functional representatives. Facilitate discussion and drive consensus regarding resolution of legal and business issues. Efficiently manage and drive multiple projects to completion.
Qualification and Experience
Requirements: JD Degree from nationally recognized Law School. 8+ years of legal or compliance experience. Experience counseling clients on health law compliance issues. Experience in fraud and abuse laws, including the Anti-Kickback Statute and its safe harbors and the Stark Law. Analytical risk identification, evaluation, and management experience. Nice to Have: Medical device industry experience. Familiarity or experience with payer, provider, and reimbursement issues. Understanding of value-based healthcare . Excellent written and verbal communication skills . Demonstrated strong analytical thinking ability . Ability to work on multiple projects at the same time. Superior common sense and judgment. Integrity and strong ethical center. Capable of inspiring trust and confidence of business partners. Must have strong legal skills and judgment and the ability to assess and advise on complex risks while interacting effectively with a variety of individuals across the organization. Requires a high level of professionalism and responsiveness to business stakeholders in a large, dynamic and fast-paced environment.
