Deputy District Attorney The candidate: Prosecutes driving under the influence, misdemeanor assault, criminal mischief, theft, and domestic violence cases, violations of restraining orders, criminal stalking, child abuse and support enforcement. Staff domestic violence and child victimization cases and work closely with Intervention Project Partners, law enforcement, State Office for Services to Children and Families (SCF), advocates with the Women's Violence Intervention Program and other community partners. Works cooperatively with other DDA incumbents and support staff in the office and always function as a team member. Other duties include involvement with community violence intervention project. Assists in developing and conducting other duties related to intervention Develop, recommend and implement administrative policies and procedures relating to criminal prosecution and office management. Provide training to deputy district incumbents in criminal law and procedure, trial practice, search and seizure, search warrants and other related matters. Be a responsible trial team participant and come to trial team meetings prepared to discuss cases, receive input and offer advice and assistance to other DDAs. Provide misdemeanor assistance and advice to police agencies in investigating cases. Assist and advise police agencies in applications for arrests and search warrants and assist in drafting these warrants when necessary. Respond to request for warrants at all times day or night. Teach basic criminal law and search and seizure to police personnel. Analyze facts and legality of misdemeanor criminal investigations; determine whether investigations are complete and sufficient to present to the grand jury for charging decisions; formal indictment process; analyze police reports, evidence in search warrant affidavits; review legal issues and request further investigations; interviews, prepare and subpoena witnesses to testify. Prepare for and appear at daily circuit court arraignments, release hearings and other miscellaneous proceedings. Communicate with defense bar regarding district court matters and keeps District Attorney (DA) apprised involving significant and sensitive cases. Assumes management responsibility for one or more program areas. Research and draft legal opinions and memoranda in response to defense motions. Initiate motions on behalf of the State of Oregon. Litigate pretrial motions and prepare trial strategy to prosecute criminal cases. Litigate misdemeanor cases on behalf of the State and Circuit Court which includes formulating trial strategy, preparing and scheduling trial witnesses, examining prospective jurors to select an impartial jury; present opening remarks, examines and cross examines witnesses; argues objections and mid trial motions; present closing remarks. Takes as much time as necessary to prepare cases adequately. Formulate and regulate appropriate sentences based on criminal convictions and other related factors. Present evidence of witnesses to support sentencing recommendations. Provide support and assistance to victims; assist in obtaining counseling and other victim services; and make them aware of case proceedings. Analyze probation violation reports to determine whether to proceed with probation violation hearings. Initiate and prosecute probation revocations arising out of misdemeanor convictions. Prosecutes violations of diversion agreements. Provide, on a scheduled basis, off hour, 24 hour a day on call service to police agencies requiring assistance during nights or weekends which requires the on call deputy district attorney to carry a pager at all times and remain in Lincoln County. Respond to crime scenes if asked by police agency and at the direction of the DA and/or Chief Deputy District Attorney (CDDA). Provide, on a scheduled basis, circuit court coverage for appearances as assigned including arrangements, release hearings, competency hearings, juvenile hearings, mental commitment hearings, child support hearings, restitution hearings and probation violation hearings. Work cooperatively with other DDA incumbents and support staff in the office and always functions as a team member. Should have a doctor of jurisprudence degree from an accredited law school. Member of the Oregon State Bar in good standing at the time of the appointment. Must complete a required number of continued legal education credits for each reporting period. Any satisfactory combination of experience in training that demonstrates possession of the required skills and potential.
