Attorney
Duties : Under the general supervision of the General Counsel and direct supervision of the Regional Director, acts as the investigating and prosecuting attorney in the difficult legal matters involving complex, difficult, and sensitive unfair labor practices of the Agricultural Labor Relations Act. Investigates ULP charges in conjunction with Field Examiners; prepares legal memos and advice requests; participates in and prepares charge disposition memoranda; provides ongoing legal guidance and advice to further investigations. Prepares complaints; prepares legal documents including motions, petitions, subpoenas, briefs, correspondence, and settlements; responsible for administrative hearings and trial preparations including witness preparation; independently presents the difficult and complex cases before Administrative Law Judges. Oversees the preparation of back pay and makewhole specifications; completes final specifications and notices of hearing; prepares legal documents including motions, petitions, subpoenas, briefs, correspondence and settlements; responsible for administrative hearings and trial preparations including witness preparation; independently presents the difficult and complex cases before Administrative Law Judges. Investigation of representation petitions; work with Field Examiners in pre-election conferences; and post-election challenge ballot investigations. Duties to include conducting outreach to diverse stakeholder communities and other misc. tasks, as assigned.

Qualification and Experience

Qualification : Should have active membership in The California State Bar. (Applicants who are not members of The California State Bar but who are eligible to take the California State Bar examination or are in their final year of law school will be admitted to the examination but will not be considered eligible for appointment until they are admitted to The State Bar.).

Desirable Qualification : In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate: Bilingual in Spanish and English. Experience working with low-wage immigrant populations. Familiarity with issues faced by farmworkers and the agricultural industry. Knowledge of scope and character of California statutory law and of the provisions of the California Constitution and provisions of laws and Government Code sections administered or enforced. Knowledge of principles of administrative and constitutional law; trial and hearing procedures; and rules of evidence; court procedures. Knowledge of administrative law and the conduct of proceedings before administrative bodies; legal terms and forms in common use; statutory and case law literature and authorities. Knowledge of legal research methods and performing research; legal principles and their application. Ability to analyze situations accurately and adopt an effective course of action; prepare and present statements of fact, law, and argument clearly and logically in written and oral form. Ability to draft opinions, pleadings, rulings, regulations, and legislation; negotiate effectively and conduct crucial litigation. Ability to prepare correspondence involving the explanation of legal matters; research; analyze, appraise, and apply legal principles, facts, and precedents to legal problems; work cooperatively with a variety of individuals, organizations and maintain the confidence and respect of others. Ability to work efficiently under pressure.
