Attorney Senior - Employment Law Duties: Gives legal advice to the Company on human resource issues, working with HR staff as well as management in the Company. Studies legal decisions and proposed and existing statutes and regulations affecting the organization and advises affected departments. Gives legal advice with respect to administration and prepares resolutions and forms. Reviews and approves correspondence and statements from a legal standpoint. Anticipates and guards against legal risks involving the organization. Participates in legal actions. Helps plan strategies to mitigate proactively HR-related risks. Oversees outside counsel. Identify potential legal issues related to HR business practices and policies and advise client/management. Review and interpret legal decisions and proposed and existing statutes and regulations. Develop and review corporate governance and compliance procedures. Provides support for litigation, investigations and trials. Interacts with internal and external legal counsel. Interact with senior management on a variety of legal issues. Draft, and/or review contracts, endorsements and agreements, restructuring where necessary to meet requirements. Provide legal advice on complex issues which require significant legal and business experience.

Qualification and Experience

Requirements: Degree in law and admission to the state Bar and 5+ years of specialized legal experience in: Hiring and recruiting, such as analyzing results of background checks to ensure compliance with the Violent Crime Contract Act, Fair Credit Practices laws, and EEOC standards. Employee relations, such as providing legal advice and consultation with HR business partners regarding employee conduct and discipline, FMLA, OWBPA, and preparing separation and severance agreements. Compensation and benefits, such as providing advice on employee benefit plans and FLSA issues. Responding to external inquiries such as EEOC and MDHR charges and supplemental requests, and correspondence with employee attorneys. Monitor case law and legislation to ensure that internal practices are compliant and that staff are alert to key developments that impact Blue Cross practices. Drafting HR policies. Requirements: Experience in health law, such as: Matters related to health insurance and health plan statutory and regulatory requirements in Minnesota (knowledge of other states helpful) and interaction with Federal law. Matters related to health plan operations including, for example, product planning, membership, COBRA and coordination of benefits. Matters related to health care reform and Affordable Care Act compliance and requirements applicable to health plans and employers, including regulations and other guidance across all market segments. Matters related to public and private health insurance exchanges. Matters related to Federal and state regulatory filings, such as health insurance contracts. Drafting, negotiating and reviewing legal agreements.Preparing and communicating legal summaries of laws, regulations, and subregulatory guidance, and assistance with implementing existing and new programs, policies and procedures.
