Falmouth office of our client seeks complex litigation attorney with 10+ years of experience including trials, appeals, and contested foreclosure matters. The candidate will review and analyze pre and post-judgment title issues to ensure marketable title to our clients or identify potential title issues and assess resolution options. Will draft substantive pleadings, motions, and memoranda; formally appear at court hearings, mediations, depositions and trials on behalf of client. Must be in good standing and active in preferably all state and federal courts of Rhode Island, Massachusetts and New Hampshire as well as the First Circuit Court of Appeals. Knowledge of residential foreclosure process and general real estate law, including litigation, title curative / title claims, and post-judgment litigation is needed. Experience handling FDCPA, RESPA, and TILA claims, predatory lending/consumer claims and as well as creditor rights generally is essential. Experience with propounding discovery and assisting clients with responses to discovery requests, including identifying responsive documents is essential. Should preferably have 5+ years of experience in foreclosure/default servicing and 2 years of experience in title resolution and claims work.
