General Counsel and Chief Administrator of Human Resources
Duties: Providing advice and counsel and representing the agency in matters involving the NJLAD, the CRA, and other state and federal employment discrimination and anti-harassment statutes; state and federal FMLA and disability claims; state and federal wage and hour laws and the FLSA; ADA, 504laws, and accommodations; equal pay; workers’ compensation; affirmative action and diversity; CEPA/whistle blowing; employee discipline and termination; layoffs and reorganizations; and wrongful discharge claims. Representing the agency in litigation and hearings in all matters before federal, state and local courts of law, administrative courts, state and federal administrative agencies, and state and local human rights agencies, including municipal court, the NJOAL, OFCCP, NJDOL, DCR, EEOC, and NJDOH. Conducting investigations (including interviews) and drafting investigation reports and written decisions resolving internal employee complaints alleging harassment, discrimination and/or retaliation as prohibited by anti-discrimination laws. Cost-effectively managing outside counsel and employment litigation handled by outside counsel, and interfacing with outside counsel to keep legal costs at the bare minimum. Overseeing, reviewing and approving all leave of absence requests under FMLA, workers compensation, and ADA and 504 laws, and ADA requests for accommodations. Drafting, updating and issuing/disseminating all employee-related records, instruments and agreements to ensure compliance with current laws and agency goals, including school employment contracts, school renewal/non-renewal letters, release agreements, settlement agreements, annual employee handbook, annual agency risk management plan and program, annual agency continuity of operations plans, HR and Legal administrative policies and procedures, new/current job descriptions, and all HR forms, letters and templates. Developing, approving and implementing layoffs,reorganizations and employee terminations, including drafting notices of layoff and layoff related agreements and drafting/approving letters of termination of employment. Developing and delivering regular training, including new employee training, in the areas of harassment, discrimination and retaliation, ADA laws and accommodations, cultural competency, reporting obligations, and any other areas assigned. Reviewing and approving the propriety of all requests for records submitted by third parties, including subpoenas, court orders and client releases, and interfacing with such third parties to respond to such requests. Serving as the agency’s Title VI Officer and AA/EEO officer,including developing, drafting, and updating the agency’s Title VI Plan,Affirmative Action Program/Plan, and Cultural Competency Program and Plan. Drafting, reviewing and approving all contracts and agreements entered into by the agency. Managing and responding to the agency reporting hotline phone number. Recommending and implementing insurance coverage for all agency operations, including completing all renewal insurance applications. Reporting all claims made by employees and third parties against the agency (including workers compensation, general liability, student accident, volunteer accident and employment practices liability claims) to the carrier or third party administrator, and regularly interfacing with the carrier or administrator to expedite claim resolution. Ensuring compliance with OSHA and employee health and safety requirements, including all agency OSHA reports. Establishing pay scales and compensation as needed to ensure compliance with equal pay laws, as well as adjusting, prorating and implementing salaries for all ten-month school employees. Preparing and drafting HR-related and Legal Department-related policies, records, reports, plans and other information requested by accreditation agencies and licensing bodies, including CARF, DMHAS and OOL,as part of their reviews and audits, and serving as the HR and Legal point of contact and liaison for such reviews. Developing, implementing and managing employment law compliance initiatives and HR initiatives and practices, and serving as daily legal advisor to the CEO, administration and managers on all employee relations and employment law-related matters. Responding to employee relations issues including, harassment and discrimination complaints, grievances, and employee discipline issues. Coordinating, guiding and managing the overall provision of Human Resources services, policies, and programs for the entire agency in various functional areas, including employee relations, compliance development,records management, compensation, and personnel actions. Responsibilities also include providing counsel and drafting comprehensive documents on a wide range of healthcare related legal matters including HIPAA, HITECH, privacy laws, and NJDOH regulatory compliance and licensing matters. Such responsibilities include, but are not limited to, reviewing,drafting and negotiating business associate agreements, health care contracts,annual APN collaborative agreements and joint protocols, affiliation agreements, corrective action plans/plans of correction, administrative policies and procedures compliant with HIPAA and privacy laws, and other documents and agreements.

Qualification and Experience

Qualifications: JD Degree from an accredited ABA law school. Current license to practice law in NJ. 10+ years of experience as a practicing litigation attorney which includes at least five years of experience handling employment litigation and conducting harassment and discrimination investigations, or three years of experience as in-house counsel for a large public or private organization focusing on labor and employment law matters and internal investigations. Working knowledge of all aspects of employment law and ability to work independently with minimal supervision.
