Director/Attorney The candidate is responsible for collective bargaining, contract administration, arbitrations, unfair labor practice investigations, representation matters, providing accurate and timely legal advice and other support, and the implementation and administration of various workplace initiatives. Reports to the Vice President and Counsel, Labor Practice Group, and offers high visibility throughout the organization, as well as interaction with senior company leaders. Act as company spokesperson and lead negotiations for collective bargaining agreements at locations throughout the United States in collaboration with senior management and HR generalists. Ensure negotiations result in agreements that are consistent with national business priorities. Ensure alignment between workforce relations policies and other key constituencies such as HR, Benefits, Safety, Operations and Fleet Management. Develop and help business administer strike contingency plans at the Regional level. Analyze employment data and cost bargaining proposals. Identify relevant trends, events or political developments that may impact the Company’s business strategies. Litigate arbitrations. Assist with NLRA-related litigation and case handling. Direct the company’s response to RC and other petitions. Administer the company’s positive workplace development programs. Perform other job duties as assigned. Requires a deep practical knowledge industrial relations, subject matter expertise in traditional labor law, including recent changes to NLRA case law, and working knowledge of the LMRDA, OSHA, FLSA, ADA, FMLA, and workers compensation laws. Must be actively licensed to practice in their home state, and must have demonstrated experience negotiating and administering collective bargaining agreements, managing NLRB investigations, and handling arbitration cases. Experience influencing front-line managers and HR Generalists is preferred. Exceptional non-lawyer candidates with strong HR backgrounds may be considered for an Associate Director or Director role. A J.D. from an accredited law school and a license to practice law and in good standing under the Bar of the state of residence (or exceptionally strong and relevant HR background). Demonstrated direct relevant Industrial Relations experience. Demonstrated arbitration experience. Demonstrated NLRB case-handling experience. Ability to work effectively and cooperatively on projects with business executives, front-line managers and human resources professionals. Demonstrated business acumen, professional competence and integrity. Strong written and verbal communication skills.
