Bankruptcy
Legal & Bankruptcy Assistant Duties: Perform and support legal functions, including representing in bankruptcy matters, preparing legal pleadings, contract administration, and file maintenance, to help ensure timely and complete execution and maintenance of legal obligations. Prepare legal documents (e.g. pleadings) for review by Associate General Counsel and/or Associate Counsel. Provide administrative support to the Legal Department. Process bankruptcy notifications in compliance with bankruptcy laws. Research and analyze loans subject to bankruptcy to identify opportunities to mitigate losses and maximize recoveries. Act as the Credit Union’s representative in collection, legal, and bankruptcy matters, including appearances at bankruptcy proceedings as necessary and assisting internal and external members with inquiries and problem-resolution. Communicate with member’s attorney, and if permissible, with the member directly, to determine resolution of debt, whether repayment; surrender of collateral; or charge off of unsecured or under-secured debt. Maintain relevant legal files, documents, and thorough electronic documentation including individual account activities and notes. Perform skip traces to locate debtors when necessary. Maintain and adhere to schedule of important and time-sensitive events such as hearings, meetings, conferences, and deadlines. Monitor loans throughout recovery and bankruptcy process to ensure compliance. Arrange for surrender of collateral and its subsequent maintenance while in SELCO possession; execute disposition of collateral. Prepare, maintain, and present reports to track bankruptcy data such as potential loss exposure, recovery of debts, and emerging trends. Perform a variety of tasks including: processing Chapter 13 and recovery payments, account research, and collateral insurance tracking. Review procedures and policies, recommend appropriate changes, and implement changes as approved. Maintain and utilize thorough understanding of legal processes, the Fair Credit Report Act, Equal Credit Opportunity Act, and any other federal or state credit and collections laws that apply to credit unions. Greet and interact with internal and external members and customers in a warm and friendly manner, demonstrate a sincere interest and willingness to help. Assist with department-related projects and special assignments, as requested. Demonstrate leadership skills and uphold mission statement, corporate values, service promises, and exceptional customer service standards. Adhere to federal and state regulations, Credit Union policies, confidentiality requirements, and other compliance obligations. Consistently achieve individual performance goals and contribute to branch and organizational objectives. Attend and actively participate in required meetings and trainings. Adapt to change to accomplish goals and objectives. Research, resolve and/or report issues and potential problems to management and/or other business units. Perform other duties as assigned.
Qualification and Experience
Qualifications: High school diploma or equivalent; and Graduate of accredited paralegal program or equivalent related experience; and Prior legal and bankruptcy work experience is preferred; and Must be bondable. Excellent customer service skills. Excellent written and oral communication skills; ability to communicate effectively and project a professional image when giving and taking information in writing, in person and over the phone. Sophisticated computer and software skills, including knowledge of Microsoft Office software, Symitar, and departmental computer systems. Effective interpersonal skills with the ability to work with individuals and groups at all organization levels; ability to work independently and as part of a team. Good time management and organizational skills with a high level of initiative, responsibility, and accountability, including the flexibility to adapt to changing business needs and deadlines. Strong analytical ability with active listening skills. Ability to work accurately with close attention to detail. Strong problem resolution and prevention skills. Ability to maintain confidentiality of sensitive information. Willingness and ability to receive, give, and assimilate coaching and feedback.
