Staff Attorney E7 The candidate provide legal advice and support for the Family and Social Services Administration (FSSA), Division of Disability and Rehabilitative Services, Bureau of Development Disabilities and Bureau of Quality Improvement, which provide services for individuals with developmental disabilities to assist them with living independently in the community and monitors the quality of care and the facilities of those who are approved to provide these services in Indiana. Will provide legal advice to one or more divisions and benefit programs administered by FSSA. Perform complex legal research. Prepare legal memoranda in response to legal questions and provide input on policy formation and implementation. Represent one or more FSSA divisions at mediations and administrative hearings. Representation includes developing case strategy, working with clients to achieve desired goals, preparing motions and briefs, prepping witnesses, and litigating cases before an administrative law judge. Assist in the administrative rule promulgation process. Duties include reviewing, managing, and drafting administrative rules, and providing legal guidance to the client regarding the options to achieve policy goals and to ensure the clientâ€™s proposed rules meet legal requirements. Liaison to the Office of the Attorney General (AG) and outside counsel in devising strategies for litigation involving benefit programs administered by FSSA. Assist the AG and outside counsel in understanding client programs and goals. Analyze allegations of lawsuits by recipients, applicants, and providers. Assist with drafting pleadings. Review settlement proposals and make recommendations to divisions. Provide legal analysis for proposed and final bills set forth in the Indiana Legislature. Recommend alternatives and advice on implementation for all assigned program areas to determine the impact on legal responsibilities and operations. Respond to Access to Public Records (APRA) requests and advise the agency on Open Door Law. Provide legal analysis and develop appropriate responses on public access laws, including responses to informal and formal complaints made to the Indiana Public Access Counselor. Respond to inquiries from legislators, general public, and attorneys for all assigned program areas.
Qualification and Experience
Qualification: The candidate should have doctorate of law from an accredited law school and be a member in good standing of the Indiana State Bar. 1-2 years of experience practicing law, with some experience in administrative heardings and disability and health law is preferred. Intermediate proficiency in Microsoft Office programs and legal and administrative databases like Lexis Nexis and SharePoint is essential. Familiarity with the federal statutes, Code of Federal Regulations, Indiana Statutes and Indiana Administrative Code. Understanding of the Administrative Rules and Procedures Act, technical writing skills, and the ability to assist in the drafting and promulgation of administrative rules is essential. Must have effective communication skills, including the ability to communicate orally and in writing with the general public, agency personnel, legislators, and outside attorneys to respond to questions or resolve a dispute. Thorough knowledge of the rule promulgation process and the drafting of legislation is preferred. Recent legal writing sample of no more than 10 pages, preferably a legal brief or memorandum is required.
