Attorney III - Public Defender The candidate performs responsible and complex professional legal work involved in the performance of professional legal services including criminal investigations, trial preparations, and defenses. Work involves performing legal services at the full performance level of professional difficulty and requires the application of learned judgment and technical proficiency in the completion of assignments. Defends misdemeanor, juvenile and felony cases, up to and including murder. Prepares and oversees the preparation of legal briefs and memoranda. Prepares and presents evidence in criminal actions to include legal arguments regarding Mohave County Personnel Policies and Procedures, and Department Regulation. Conducts plea negotiations. Negotiates pleas in criminal cases in behalf of indigent clients. Interviews victims, witnesses, clients or prospective clients in the office, in custody and in other environments as necessary. Performs legal research in connection with legal writing and legal arguments. Communicates with civic and governmental agencies regarding rehabilitation programs for clients. Provides advocacy at sentencing proceedings. Works with the Probation Department on behalf of clients. Handles probation revocation hearings. Communicates and acts in a professional manner with the public, co-workers, and work contacts. May supervise less experienced attorneys. Writes and researches appellate briefs and argues appeals taken to the Supreme Court or Court of Appeals.

Qualification and Experience

The candidate must have admission to the Bar of the State of Arizona and eligibility to practice law before the courts of the State of Arizona. Should have 5+ year of progressively responsible experience in professional legal work. Demonstrated trial skills through performance of both bench and jury trials at a Superior Court level is needed. Knowledge of: Principles of criminal law and of the methods and practices of pleading and trial advocacy; Judicial procedures, rules of evidence and rules of criminal procedure, especially Arizona rules; Principles, methods, materials, practices, and references utilized in legal research and presentation; Methods and practices of pleading criminal cases and of effective techniques in the presentation and preparation of cases in court; Interviewing and investigative techniques; Arizona Supreme Court rules of Professional Conduct. Ability to: Analyze, appraise and organize facts, evidence and precedents and to effectively present such materials in writing and orally; Understand and interpret constitutional provisions, statutes, administrative regulations and precedents; Understand, interpret and apply pertinent federal, state and local rules, regulations, procedures and policies regarding legal work and services to include departmental procedures and requirements is must.
