Attorney-Bankruptcy Associate Responsibilities: Oversee and handle escalated or more complex cases and provide problem resolution leadership as to those matters and similar generally related matters within the department. Facility escalated issues and cases with management and/or other departments as appropriate. Identify and communicate to manage complex issues and problems concerning escalated, complex and unique loans individual in handling. Assist with ongoing training of employees, and share knowledge and development opportunities to clarify guidelines and strengthen understanding of department expectations. Work with management to set productivity goals. Ensure department, as well as regulatory requirements, are strictly adhered to. Prepare timely and accurate responses to all internal and external audits, compliance reviews, requests for information, etc., ensuring information is provided in accordance with organizational policy and standards as well as regulatory requirements. Prepare and submit departmental reports to management as requested. Perform quality control initiatives, review quality control data, and address/correct any deficiencies. Provide legal support in the Default Litigation Department for customer complaints, client issues, and attorney assistance for cram-down and adversary bankruptcy proceedings. Monitor bankruptcy proceedings handled by the Default Litigation Department; report to Manager on issues presenting litigation exposure for DMI and Clients. Confirming departmental BK policies and procedures are properly updated and modified on a quarterly basis. Assemble and review information needed to prepare answers and responses to cram-down and adversary bankruptcies. Serve as conduit between client, other DMI departments, and counsel with respect to cram-down and adversary bankruptcies in order to protect DMI’s and Clients’ interests. Attend depositions, trials and mediations when Dovenmuehle is required to provide testimony related to debt or servicing functions. Review and respond to correspondence received from attorneys or borrowers related to loans in active bankruptcy. Assist Default Litigation Manager/AVP with everyday tasks and escalations, with providing updated reports to senior management, with gathering documentation/information and drafting responses to investor and regulatory audits and requests, and with other tasks and duties as assigned. Serve as department lead and represent the department on special projects. Coordinate and facilitate staff training. Assist department management in identifying, communicating, and implementing departmental standards and practices. Identify and facilitate learning and team-building opportunities. Successfully complete annual regulatory compliance training. Monitor and stay current in mortgage servicing matters as well as organizational policies and procedures. Maintain high levels of cooperation and rapport with team members to promote accurate and efficient operations and service; maintain visible presence and availability throughout the department. Formulate and communicate suggestions that may improve profitability and/or productivity.
Qualification and ExperienceQualifications: Juris Doctor and/or 5+ years experience in default servicing industry preferred. Should have 5+ years of experience in mortgage servicing. Prior default servicing law firm experience preferred. Strong knowledge of mortgage compliance and regulations. Strong analytical and problem-solving skills and attention to detail. Proficiency with Microsoft applications and mortgage servicing platforms. Effective verbal and written communication skills with demonstrated ability to interact in a positive and professional manner at all times with all levels of both internal and external audiences, including the ability to handle confidential or sensitive information with discretion. The ability to motivate others and serve as a role model for organizational and departmental initiatives, procedures, and values. Preferred Qualifications: Should have 3+ years of supervisory experience. Experience in a legal environment related to compliance, mortgage servicing, and/or vendor management; experience with foreclosure and bankruptcy attorneys and the foreclosure and bankruptcy processes; experience with LPS and Fidelity systems.
