Senior Corporate Counsel, Litigation and Investigations
The candidate will be responsible for managing litigation, internal investigations, government inquiries and claims involving a variety of U.S. practice areas. The person filling this position must have knowledge of the healthcare and pharmaceutical industries, must be an effective communicator, and have the ability to work with colleagues in Legal and diverse functional and operational areas throughout the company (such as HR, Finance, Pharm Ops., Business Development, IA, IS, etc.). The person filling this position must have the ability to analyze complex situations, develop and communicate plans of action and carry them out. The person filling this position may also provide advice and counsel on business issues and the legal implications of those issues. Support of a diverse caseload, including development of action plans and communication of issues, status, case developments, and litigation risks. Case load will include handling government and internal investigations, government subpoenas, regulatory/administrative proceedings, , false claims act (“qui tam”) litigation,, class action litigation, and general commercial litigation. Conduct and document Internal Investigations relating to potential violations of company compliance policies/SOPs or law. Supervise the collection and production of documents during discovery of pending litigation and in response to subpoenas, preserving all privileges. Effectively work with outside counsel to determine case strategy, spearhead discovery efforts through collaboration with the business and IS colleagues, manage outside counsel spend. Analyze complex situations; develop, communicate, and carry out plans of action. Maintain detailed knowledge of the legal and regulatory environmental and current developments in those areas, and proactively apply that knowledge to matters, Develop trust and instill confidence in senior management; advise management of significant case developments and risk area, and recommend strategy accordingly, Resolve disputes with other companies or individuals through negotiation or mediation with or without the involvement of outside counsel, Lead and participate in cross-functional teams throughout the Company, including providing direction to employees in other functional areas with which there is no reporting relationship, Devise novel solutions to problems and execute, Demonstrate values and commitment to compliance on a consistent basis, Perform other duties as requested, The position has indirect managerial oversight of mid-level legal professionals, and must be able to lead and participate in cross-functional teams throughout the company, including providing direction to employees in other functional areas with which there is no reporting relationship. This position manages the performance of outside counsel.The position does not have budgetary responsibility. J.D. degree from an accredited law school is required. Admission to at least one State Bar is required. Should have 10 years of litigation and/or government investigation experience working in a law firm or in-house legal department is required. Substantial healthcare and/or pharmaceutical industry experience is required. Working on matters involving claims under the False Claims Act and the Anti-Kickback Statute is preferred. Strong academic credentials. Other regulatory, compliance or business experience. Significant experience with complex litigation is required. Knowledge of pharmaceutical compliance environment and FDA requirements is strongly preferred. Experience and expertise in conducting internal and/or government investigations is strongly preferred. Experience working independently and effectively with cross-functional groups, such as Legal, Compliance, Regulatory, Medical and Commercial while maintaining strict compliance with relevant laws, regulations and policies,. Computer proficiency required. Project management experience, or skills are desirable.
