ProfileCounsel I – Consumer Finance and Real Estate The candidate will be responsible for supporting firm's Destinations consumer finance business unit. The responsibilities will include, without limitation, practicing across a range of disciplines, including consumer finance, collections, real estate, underwriting, lending, and consumer protection. Will serve as the primary legal support for the consumer finance business unit including, without limitation, providing proactive legal support and advice with regards to all issues relating to consumer finance and real estate title. Provide proactive legal, regulatory, and compliance advice and support relating to the following laws and regulations: UDAAP, FDCPA, FCRA, TCPA, TILA, RESPA, TRID, ECOA, EFTA, NACHA, and E-Sign Act. Provide proactive legal advice and support to the team responsible for underwriting, originating, and servicing a large portfolio of loans including, without limitation, providing legal advice regarding licensing requirements for brokers, originators, services, and collectors in at least 26 states. Manage, maintain, and modify (as necessary) the company’s CMS program as required by the CFPB including, without limitation, drafting, reviewing, and revising required policies and trainings, conducting periodic assessments, and implementing necessary changes identified during any such assessments. Draft, review, and revise (as necessary) real estate purchase and sale agreements, mortgages, promissory notes, and retail installment sales contracts for use in at least 26 states. Track, analyze and provide guidance on new and changing state, federal, international laws related to real estate, sales, finance, mortgage, and licensing to manage and minimize impact to firm's business operations including, without limitation, working with trade organizations and lobbyist when appropriate. Assist with the supporting the anti-corruption, anti-fraud and anti-money laundering programs. Performs other duties as needed.
Qualification and Experience
The candidate should have Juris Doctorate degree from accredited law school. LLM degree or Certification in Banking and/or Financial Services, preferred. Must have 5 years of legal experience focused primarily on consumer financial services, preferably with a consumer finance company or mortgage lender. Must be Admitted to Bar Association in at least one state. Must have deep working knowledge of state, federal, and international laws and regulations related to consumer finance, collections, underwriting, mortgages, lending, consumer protection, and real estate related laws, regulations, and industry best practices. Must have a deep and specialized knowledge of the federal regulations related to consumer financial services, such as UDAAP, FDCPA, FCRA, TCPA, TILA, RESPA, TRID, ECOA, EFTA, NACHA, and E-Sign Act, as well as having substantial experience in advising clients on how to comply with said regulations. Must have a sound understanding of various state regulations related to consumer financial services, such as licensing requirements, collections, and consumer protection. General corporate/commercial experience is required. Experience working for a financial services, lending, collections, or banking company, preferred. Experience working with a publicly traded company, a plus. Experience working with condominium and timeshares, a plus. Knowledge of Microsoft Office Products is required. Must have proficiency in legal research, including applications, the Web and other sources.
