General Counsel The candidate plans, organizes, and supervises the development and implementation of all legal services necessary to the Department. Reports directly to the Secretary of the Department and includes providing advice to the Department's program areas, executive staff, and employees in order to transact the Department's official business. Provides or supervises the provision of legal representation for the Department in all administrative hearings, civil trials, and appellate proceedings. Develops effective legal recommendations that impact policy decisions in the following areas:procurement, bid disputes, public contracts interpretation, regulatory law, real property, building construction, technology, ethics issues, health insurance matters, collective bargaining, rulemaking, labor and employment law, and litigation impacting the Department. Assists the Department's leadership team with the Department's legislative activity. Provides legal opinions to the Secretary and leadership team and advises personnel regarding statutory duties and functions of the Department. Advises and provides legal counsel to the Department's Secretary and other agency management on departmental issues. Serves as the Chief Ethics Officer. The Chief Ethics Officer is responsible for ensuring all employees adhere to the Governor's revised Code of Ethics and the Code of Ethics. Supervises attorneys, who provide legal advice, and OGC staff, who provide support to the OGC and Department. Serve as the DMS Chief Ethics Officer. Work closely with and support the Secretary and Executive Leadership. Provide competent legal advice and counsel to the Secretary, Executive Leadership Team, Program areas, and Program Directors on a wide variety of issues. Provide legal representation for DMS in public procurement and contracting. Provide legal representation for DMS in administrative and civil proceedings. Oversee Department rulemaking activities. Provide oral and written advice to the Secretary and Executive Leadership Team based on a thorough understanding of the applicable law and an accurate knowledge of the facts. Develop and maintain positive and professional relationships with internal clients and external stakeholders. Execute job responsibilities in accordance with all legal and ethical requirements. Effectively communicate complex and technical information to various audiences. Generate polished and accurate written work product. Lead and manage several attorneys and support staff to ensure that OGC and agency goals and mission are achieved. Anticipate and recognize potential issues and proactively gather information, persuasively present information and propose resolutions, seek and build consensus, and escalate issues as appropriate.
Qualification and Experience
The candidate should have a J.D. degree from an accredited law school. Should also have admission to and good standing with the Florida Bar. Must have 5+ years of experience as a licensed attorney. Experience with Florida's competitive procurement and pubic contract processes is required. Experience leading and supervising attorneys and support personnel is needed. Should have demonstrated success in strategically managing a diverse workload of legal projects and subject matter and achieving client goals. Experience with ethics compliance issues is preferred. Experience with Florida's public records law is desired. Experience with administrative and civil litigation is an asset. Experience with Florida rulemaking is a plus.
