Assistant County Attorney
The candidate under the direction of the County Attorney, serves as legal representative and advisor to the Board of County Commissioners, and other Elected Officials, directors and individuals requiring legal advice, when no conflict exists; assists with review of documents in Inspection of Public Records (IPRA) requests; represents the County in legal proceedings, including District Court and/or administrative proceedings in Tax, Garnishment, and Planning and Zoning, and other matters; drafts and reviews resolutions, contracts, ordinances, and other documents; researches legal issues and prepares Memorandum of Law for the County Attorney, provides legal assistance to all County Boards and Commissions; at the direction of the County Attorney oversees outside counsels' representation of the County, and performs other support functions as directed by the County Attorney. Duties Receives, reviews and responds to Inspection of Public Record requests on behalf of the County; Researches and writes Legal Memorandum on a variety of legal issues and/or administrative practices at the request of the County Attorney; and reviews policy and policy initiatives to ensure compliance with state and federal laws and regulations; Litigates civil cases and prosecutes criminal cases on behalf of the County in Magistrate and District Courts, including but not limited to tax, garnishment, and Planning and Zoning cases; represents the County in appellate work; and represents County management and/or designated clients as needed; Provides legal assistance to all County Boards and Commissions, as directed by the County Attorney; Reviews drafts of ordinances, resolutions, contracts, administrative policies, rules and regulations, and other written documents required in the operation of the county government for compliance with legal requirements; Drafts legal documents for approval and use by the County Attorney; Composes a variety of letters, transmittal memoranda, e-mails, and other documents. Reviews and analyzes tort claims and documents served on County Clerk; and prepares County disclaimer, if appropriate, and forwards information to New Mexico Association of Counties and supervises outside counsel as directed by County Attorney; Assists with personnel issues and labor law issues including FLSA, collective bargaining, FMLA, ADA, and federal employment law; and assists with disciplinary investigations and administrative hearings. Interacts with Judges, trial court assistants, Clerks of Court, Elected Officials, deputies, and other County employees as needed/required to perform the duties of the position; Coaches, trains County staff. Assists with or performs related duties as assigned.

Qualification and Experience

The candidate Should have Juris Doctorate Degree and 2 years of experience in the practice of law including litigation and appellate experience including to the practice areas described above. Municipal/local government experience preferred. Experience in Inspection of Public Records Act, Open Meetings Act, tax, real estate, and/or State of New Mexico Procurement Code and procedures highly desirable. Admission to the New Mexico State Bar and valid license to practice law in the State of New Mexico is required. Should have admission to New Mexico Federal Bar or the qualifications to be so.
