Mitigation Attorney The candidate will support the Department of Defense’s office of Manufacturing and Industrial Base Policy (DoD MIBP) in the negotiation and monitoring of risk mitigation agreements executed under the authority of the Committee on Foreign Investment in the United States (CFIUS). Develop mitigation terms to address foreign investment risk within the United States via the review of transactions filed with CFIUS. Provide supporting analysis to transactions filed with CFIUS. Utilize a risk-management framework, in coordination with the CFIUS Case Management office, to assess the specific national security risk to the defense industrial base (DIB) and draft appropriate mitigation terms to mitigate the risk to an acceptable level. Recurring risks to the DIB that require mitigation include product integrity, supply assurance, co-location, and technology transfer concerns. Standardize language and procedures for developing mitigation terms to address foreign investment risk. Coordinate 'best practice' language for each specific mitigation term with DoD component equity holders to ensure successful compliance with risk mitigation agreements. Support MIBP's monitoring of risk mitigation agreements through deliverable reviews, on-site compliance reviews, and coordination with DoD and interagency equity holders. Liaise with corporate representatives via both individual meetings and stakeholder conferences to discuss potential transactions and related global market trends. Draft memoranda and brief DoD leadership on meetings with corporate representatives that are subject to risk mitigation agreements. Briefings would include identifying recommended talking points, requested actions, and recent relevant business and related sector activity for further discussion. Must have Bachelor's degree with a specialty in law, policy, national security and/or business. Master's degree or juris doctorate degree in one of those fields is highly preferred. Should have 4+ years of professional experience. A combination of private sector and public sector experience is desired. Active Top Secret/SCI security clearance is must.
