ProfileAttorney IV Duties: Represent the Director and Division Chiefs in administrative and state and federal trial and appellate forums in litigation involving one or more of the following substantive areas, with a concentration on item (4) on the general range of representation listed below: (1) California apprenticeship laws. (2) California public works laws, including prevailing wages and apprenticeship. (3) Self-Insured (Workersâ€™ Compensation) Plans. (4) Employment law (Government Code, Title VII, FEHA, Americans With Disabilities Act, Age Discrimination in Employment, Unemployment Insurance Code, Labor Code) related to Department personnel matters before the State Personnel Board, Department of Personnel Administration, Equal Employment Opportunity Commission, Department of Fair Employment and Housing, Unemployment Insurance Appeals Board, and related civil litigation. (5) Labor-management laws (Public Utilities Code) governing county transit districts for the State Mediation and Conciliation Service in state trial and appellate courts. (6) Information Practices Law. (7) Cases challenging the validity of Labor Code provisions under the state or federal constitutions, or federal laws. Act as Hearing Officers for the Director including workersâ€™ compensation, public works, prevailing wage, self-insurance plans, apprenticeship, and State Mediation & Conciliation cases. Advise the Director and Division Chiefs on rulemaking, legislation, and general policy issues; testify before legislative bodies; serve as counsel to boards appointed by the Governor; train other counsel and staff; and, lead and monitor work of specific substantive area legal teams within the Unit. Representation of the Director as Administrator of three workersâ€™ compensation funds (the Uninsured Employersâ€™ Fund, Subsequent Injuries Fund and the Death Without Dependents Unit) before the Workersâ€™ Compensation Appeals Boards, Reconsideration Unit, and civil appellate courts throughout California.
Qualification and Experience
Requirements: Individuals who are currently in the classification, eligible for lateral transfer, eligible for reinstatement, have list eligibility, are in the process of obtaining list eligibility, or have SROA and/or Surplus eligibility (please attach letter, if available). SROA and Surplus candidates are given priority; therefore, individuals with other eligibility may be considered in the event no SROA or Surplus candidates apply.
